Guaranty Limit Amount definition

Guaranty Limit Amount means, at any time, the lesser of (i) the difference between (A) forty million Dollars ($40,000,000) and (B) the aggregate amount of all Guarantor Payments actually made as of such time and (ii) the aggregate unpaid amount of the Guaranteed Obligations at such time.

Harvard REIT: individually or collectively, the Behringer Harvard Operating Partnership I LP, a Texas limited partnership (the “Harvard REIT Operating Partnership”) and/or Behringer Harvard REIT I, Inc., a Maryland corporation (“Behringer Harvard REIT”) and/or Behringer Harvard Opportunity REIT I, Inc., a Maryland corporation (“Behringer Harvard Opportunity REIT”) and/or any other fund for which Behringer Harvard Holdings, LLC, or an Affiliate of it under its Control, serves as general partner, manager or advisor.

  • Credit Amount has the meaning set forth in Section 4.01(b)(ii).

  • Maximum Facility Amount means the aggregate Commitments as then in effect, which amount shall not exceed $200,000,000; provided that at all times after the Reinvestment Period, the Maximum Facility Amount shall mean the aggregate Advances Outstanding at such time.

  • Maximum Loan Amount has the meaning set forth in Section 2.1(a).

  • Yield Supplement Amount means, with respect to any Collection Period and the related Deposit Date, the aggregate amount by which one month’s interest on the Principal Balance as of the first day of such Collection Period of each Discount Receivable (other than a Discount Receivable that is a Defaulted Receivable) at a rate equal to the Required Rate, exceeds one month’s interest on such Principal Balance at the APR of each such Receivable.

The Holders’ obligations to contribute pursuant to this Section 8(d) are several in proportion to the respective principal amount of the Registrable Securities held by each Holder hereunder and not joint. The Company’s and Subsidiary Guarantors’ obligations to contribute pursuant to this Section 8(d) are joint and several. The indemnity and contribution agreements contained in this Section 8 are in addition to any liability that the Indemnifying Parties may have to the Indemnified Parties.

  • Advance Reimbursement Amount has the meaning stated in Section 4.4(b) of the Servicing Supplement.

  • Advance Amount means with respect to Class A Advances, the Class A Advance Amount and, with respect to Class B Advances, the Class B Advance Amount.

  • Term Loan Amount means with respect to any Term Loan Lender, the amount equal to its Term Loan Percentage of the aggregate principal amount outstanding under the Term Loan.
