Information Blocking definition

Information Blocking means a practice by a health care provider, health IT developer, health information exchange, or health information network that, except as required by law or specified by the Secretary of Health & Human Services (HHS) as a reasonable and necessary activity, is likely to interfere with access, exchange, or use of electronic health information.¶
Information Blocking has the meaning assigned to such term in 45 CFR Part 171 and any applicable regulations promulgated thereunder that are then in effect.

Information Blocking means a practice that except as required by law or covered by an Exception is likely to interfere with access, exchange, or use of electronic health information, if 1) conducted by a health information technology developer, health information network (HIN) or health information exchange (HIE) when such Actor knows or should have known that such practice is likely to interfere with access, exchange, or use of electronic health information (EHI), or if 2) conducted by a healthcare provider when such Actor knows that such practice is unreasonable and is likely to interfere with access, exchange, or use of EHI.
