Examples of Maximum Contract Quantity in a sentence
Seller may offer to sell any RECs in excess of the Maximum Contract Quantity to persons other than Buyer.
Unless earlier terminated pursuant to the terms of this Agreement, the “Term” of this Agreement shall be from the Effective Date until the earlier of (a) the date on which the Maximum Contract Quantity has been Delivered by Seller to Buyer and payments for such RECs have been paid by the Party owing payment to the Party for which payment is due; or (b) the last day of the month immediately following the end of the Delivery Term.
Unless earlier terminated pursuant to the terms of this REC Contract, the “Term” of this REC Contract shall be from the Effective Date until the earlier of (i) the date on which Buyer has made payments to Seller in the last Delivery Year that cumulatively equal the Maximum Contract Quantity multiplied by the Purchase Price; or (ii) the last day of the month immediately following the end of the Delivery Term.
During the Delivery Term, Seller shall sell and Deliver to Buyer, and Buyer shall purchase and accept Delivery of, the quantity of RECs produced by the System, up to, but not in excess of, the Maximum Contract Quantity of RECs indicated on the System Identification Form.
In no event shall (i) payment by Buyer with respect to a Delivery Year (except for the last Delivery Year) exceed an amount equal to the product of the Purchase Price and the Delivery Year Requirement for such Delivery Year, plus interest on late payments as required herein, or (ii) payment by Buyer cumulatively exceed an amount equal to the product of the Purchase Price and the Maximum Contract Quantity, plus interest on late payments as required herein.
