Mortgaged Property Owner definition

Mortgaged Property Owner means the owner of a fee simple title (or leasehold interest to the extent permitted under this Agreement) to a Mortgaged Property.
Mortgaged Property Owner means, with respect to (i) each Mortgaged Property and (ii) each real property required to become a Mortgaged Property pursuant to Section 5.09 and/or Section 5.10, the Borrower and/or Restricted Subsidiary or Restricted Subsidiaries that own(s) such Mortgaged Property or real property, as applicable.
Mortgaged Property Owner means the owner of the Mortgaged Property that indirectly secures a Mezzanine Loan.

  • The absence of any action to enforce any of Lender’s rights under the Loan Documents or Mortgage Lender’s rights under the Mortgage Loan Documents, or available to Lender or Mortgage Lender at law, equity or otherwise, to recover any judgment against Borrower or any Mortgaged Property Owner or to enforce a judgment against Borrower or any Mortgaged Property Owner under any of the Loan Documents or Mortgage Loan Documents, as the case may be.

Mortgaged Property Owner means, individually and collectively, as the case may be: (i) initially and until such time as the Preserve Property Mortgage is released by Lender pursuant to Section 8.15 hereof or otherwise, the Preserve Property Owner, and (ii) following the effectiveness of the Phase II Property Mortgage, the Phase II Property Owner.
