Non-Settling Defendants definition

Non-Settling Defendants means any Defendant that is not a Releasee and includes any Defendant that terminates its own settlement agreement in accordance with its terms or whose settlement otherwise fails to take effect for any reason, whether or not such settlement agreement is in existence at the Execution Date.
Non-Settling Defendants means the Non-Settling Electrolytic Defendants and the Non- Settling Film Defendants.
Non-Settling Defendants means all Persons who are or may be defendants on LBO-Related Causes of Action or Morgan Stanley Claims other than Released Parties in their capacities as such.

  • THIS COURT ORDERS that, except as provided herein, this Order does not affect any claims or causes of action that any members of the Settlement Class has or may have in the Proceeding against the Non-Settling Defendants or named or unnamed co-conspirators who are not Releasees.

More Definitions of Non-Settling Defendants

Non-Settling Defendants means Defendants other than Settling Defendants.
Non-Settling Defendants means all the Defendants named in the Class Action Application, as it may be amended from time to time, excluding the Settling Defendant and any other Defendants who have entered into a settlement agreement with the Plaintiff which has been approved by the Court;
Non-Settling Defendants means, collectively, all present or future defendants in the Related Actions that are not Released Defendant Persons.
Non-Settling Defendants means any Person, other than Macquarie, who: (a) currently is a named defendant in the Action; and/or (b) was previously a named defendant in the Action but was dismissed, or is in the process of being dismissed, for any reason, whether by settlement, judgment or otherwise. “Non-Settling Defendants” specifically includes, without limitation, Puda, the Auditor Defendants, Brean, the Defaulted Defendants and the U.S. Director Defendants.
Non-Settling Defendants means, collectively, (i) all defendants in the Ally, First Horizon, SocGen, and Related Actions that are not Released Defendant Persons, (ii) any other person or entity later named as a defendant in the Ally, First Horizon, or SocGen Actions, other than the Released Defendant Persons, and (iii) any other person or entity that becomes liable (A) to Plaintiff, (B) to any defendants in the Ally, First Horizon, or SocGen Actions that is not JPMS, or (C) to any other alleged tortfeasor, by reason of judgment or settlement, or for any claims that arise out of, the Ally, First Horizon, or SocGen Actions, other than the Released Defendant Persons.
Non-Settling Defendants means Tecumseh Products of Canada, Limited, Tecumseh Products Company, Platinum Equity, LLC, Canadian Kawasaki Motors Inc., Kawasaki Motors Corp., USA, Honda Canada Inc. and American Honda Motor Co., Inc.
Non-Settling Defendants means all Defendants in the Class Action Application, excluding the Settling Defendants;
