Examples of Not to Exceed Amount in a sentence
City shall pay Consultant on a time and expense basis, at the billing rates set forth in Exhibit “B,” attached and incorporated by reference for services performed under this Agreement.3.1 Not to Exceed Amount.
In accordance with California Government Code Section 8546.7, if the Not to Exceed Amount exceeds ten thousand dollars ($10,000), this Agreement and the Consultant’s books and records related to this Agreement shall be subject to the examination and audit of the State Auditor, at the request of District or as part of any audit of the District, for a period of three (3) years after final payment under the Agreement.
Compensation to be paid hereunder shall not exceed [Written Not to Exceed Amount] ($ ) (“Not-to-Exceed Amount”) unless a larger amount is agreed to by and between the Parties in accordance with the amendment requirements of this Agreement.
CITY agrees to pay CONSULTANT as compensation for performance of all services as related to each Task Order under the terms of this Agreement a Not to Exceed Amount as agreed upon per Task Order.
The Not to Exceed Amount includes salary, fringe benefits, overhead, profit, and all other expenses incurred by the Consultant in completing its Services under this Agreement.
