Individual Class Members (as described in the enclosed Notice of Proposed Settlement) who are Retired Physicians are entitled to receive a pro rata amount of the portion of the Settlement Fund that is reserved for retired or deceased Physicians.

Forthwith after the execution of this Stipulation, counsel for the Parties hereto shall jointly submit this Stipulation to the Court and shall jointly request entry of the Preliminary Order, substantially in the form of Exhibit D hereto, requesting approval for the mailing to the Settlement Class of a Notice of Proposed Settlement of Class and Derivative Action and Hearing on Proposed Settlement in substantially the form of Exhibit B hereto.
Within twenty (20) days of Preliminary Approval of this Settlement, the Claims Administrator shall mail Notice of this Settlement to all putative Plaintiff Class Members by first-class mail in the form approved by the Court the Notice of Proposed Settlement of Class Action and Settlement Hearing (“Plaintiff Class Notice”).
Specifically, with respect to any proposed settlement or compromise of a Substantial Disputed Claim, the Post-Confirmation Debtors shall promptly send, via e-mail, facsimile or overnight delivery, a notice of the proposed claim settlement to the Committee through its counsel of record (a "Notice of Proposed Settlement").
