Parte Reveladora significa la Pa rte o una de sus Filiales que divulgue o cause la revelación de Información Confidencial a la otra Parte o a alguna de sus Filiales. 1.19. "Fecha Efectiva" tendrá el significado señalado en el preámbulo. 1.20. "Información Exceptuada" significa información que: (a) el Receptor o cualquiera de sus Representantes tuviera legítimamente en su poder, según se demuestre mediante pruebas idóneas, antes de que la Parte Reveladora la haya revelado con arreglo a este Acuerdo; o (b) estuviere generalmente disponible y fuere de dominio público en el momento de la revelación o pasare a ser pública (sin que medie infracción de este Acuerdo por el Receptor o sus Representantes); (c) el Receptor o alguno de sus Representantes obtenga legítimamente de una Persona que no haya incumplido una obligación de confidencialidad (u otra prohibición de revelar la información) frente a la Parte Reveladora, respecto de dicha información (y que el Receptor

  • Si la Parte Receptora viniera obligada por ley o por cualquier normativa o resolución administrativa o judicial a revelar dicha Información Confidencial, la Parte Receptora únicamente revelará aquella parte de dicha Información Confidencial que la Parte Receptora, en opinión de su asesor jurídico, viniera legalmente obligada a facilitar, y realizará esfuerzos razonables a efectos de mantener la confidencialidad del resto de la Información Confidencial de la Parte Reveladora.
