Performance Level IV definition

Performance Level IV means, at any date of determination, (a) that the Performance Level does not meet the requirements of Performance Level I, Performance Level II or Performance Level III and (b) that the Borrower shall have a Borrower Debt Rating in effect on such date of at least BBB- by S&P, or at least Baa3 by Moody’s.
Performance Level IV means, at any date of determination, that the Performance Level does not meet the requirements of Performance Level I, Performance Level II or Performance Level III.
Performance Level IV means, at any date of determination, that (a) the Performance Level does not meet the requirements of Performance Level I, Performance Level II or Performance Level III and (b) Fox Kids and its Subsidiaries shall have maintained a Leverage Ratio of less than 4.50:1 for the most recently completed Measurement Period prior to such date.

Performance Level IV means, at any date of determination,
