The Association and/or the School District, have the option of requesting Grievance Mediation by the Bureau of Mediation Services after Level III of the Grievance Procedure.
A request to submit a grievance to arbitration must be in writing signed by the aggrieved party, and such request must be filed in the office of the Superintendent within ten (10) days following the decision in Level III of the grievance procedure.
If there is no mutual agreement for mediation or other dispute resolution methods between the District and the Union within fifteen (15) days of the Level III decision, the District or the Union may proceed to Level V, Binding Arbitration.
If the Union is not satisfied with the decision at Level III, the union may request the matter be submitted to mediation or other dispute resolution methods.
If a grievance is occasioned by the action (or lack of action) of person(s) other than the immediate supervisor, the grievance may be filed at Level III.
