Permitted Extensions definition

Permitted Extensions means extensions to the Guaranteed Commercial Operation Date due to Permitting Delay, Transmission Delay, or Force Majeure Extension, as applicable, pursuant to Section 3.9(c).
Permitted Extensions has the meaning set forth in Section 1.1.2.
Permitted Extensions means extensions to the Guaranteed Commercial Operation Date due to Force Majeure Extension, or payment of Daily Delay Damages, as applicable, pursuant to Section 3.9(c).

Examples of Permitted Extensions in a sentence

  • If the Commercial Operation Date occurs after the Guaranteed Commercial Operation Date after giving effect to Permitted Extensions or Force Majeure, then Buyer shall be entitled to declare an Event of Default and collect a Termination Payment pursuant to Article Five.

  • If the Commercial Operation Date occurs after the Guaranteed Commercial Operation Date after giving effect to Permitted Extensions, then Buyer shall be entitled to declare an Event of Default and collect the Damage Payment pursuant to Article Five.

  • For sake of certainty, Buyer shall retain all Daily Delay Damages drawn (or which Buyer is entitled to draw) as a result of Seller’s failure to meet the Guaranteed Commercial Operation Date and the Guaranteed Construction Start Date (both as may be extended by Permitted Extensions), if Seller fails to meet the Guaranteed Commercial Operation Date (as may be extended by Permitted Extensions).

  • Seller shall be entitled to the return of all Daily Delay Damages collected by Buyer as a result of Seller’s failure to meet the Guaranteed Construction Start Date only if Seller meets the Guaranteed Commercial Operation Date (as may be extended by Permitted Extensions) as provided further in Section 8.4(c) of this Agreement.

  • Permitted Extensions shall become effective only with respect to the Commitments of the Lenders of the Specified Class that accept the applicable Extension Offer (such Lenders, the “Extending Lenders”) and, in the case of any Extending Lender, only with respect to such Lender’s Loans and Commitments of such Specified Class as to which such Lender’s acceptance has been made.


More Definitions of Permitted Extensions

Permitted Extensions means extensions to either of the Construction Start Date or Guaranteed Commercial Operation Date due to Permitting Delay, Transmission Delay, Force Majeure Construction Extension, as applicable, pursuant to Section 5.3 or 5.4.
Permitted Extensions means extensions to the Guaranteed Commercial Operation Date due to Transmission Delay, Permitting Delay, or Force Majeure Extension.
Permitted Extensions means extensions to either of the Guaranteed Project Milestones due to Permitting Delay, Transmission Delay, Force Majeure Construction Extension, as applicable, to each Guaranteed Project Milestone pursuant to Section 3.9(c)(iii)(A) or (B), as applicable.
Permitted Extensions means, collectively, all extensions due to (a) Force Majeure pursuant to Section 12, Force Majeure, but in no event shall such extension exceed one hundred eighty (180) Days from the aforesaid date, (b) a breach of this Agreement by Buyer, (c) Interconnection Delays and (d) if applicable, an extension in the MPSC Approval Deadline pursuant to Subsection 2.1, Effective Date and Term.
Permitted Extensions. Means, collectively, all extensions due to (a) Force Majeure pursuant to Section 12, Force Majeure, (b) a breach of this Agreement by Buyer, (c) Interconnection Delays and (d) if applicable, an extension in the MPSC Approval Deadline pursuant to Subsection 2.1, Effective Date and Term, but in no event shall such extensions from parts (a) through (d) exceed two hundred forty (240) Days in total.
Permitted Extensions means the extensions to the Target Commercial Operation Date set forth in Section 4.2.
