Person responsible for the violation definition

Person responsible for the violation means any person who is required by the applicable regulation to comply therewith, or who commits any act or omission which is a civil violation or causes or permits a civil violation to occur or remain upon property in the city, and includes but is not limited to the owner(s), lessor(s), or other person(s) entitled to control, use and/or occupy property where a civil violation occurs.

For violations of city tree regulations, this definition includes any person who caused or participated in the removal of a tree in a manner that constitutes a civil violation.

Person responsible for the violation means any person who has an interest in or resides on the property, whether as owner, lessor, tenant, occupant or other person entitled to control, use and/or occupy the property.

Examples of Person responsible for the violation in a sentence

• Unless otherwise designated as a criminal offense in this Section, if a violation continues past the compliance time set forth in the Notice of violation, a civil citation may be issued to the Person responsible for the violation.

• The burden of proof from demonstrating that the violation was not deliberate or in reckless disregard is on the Person responsible for the violation.
