Personal Injury Claim definition

Personal Injury Claim means, with respect to any Policy, all Liabilities of the Dividing Company under the terms of such Policy for claims made by an Insured Person, an Injured Person or any other Person with respect to one or more of the following types of coverage: bodily injury liability, Personal Injury Protection, uninsured motorists’ bodily injury liability and underinsured motorists’ bodily injury liability.
Personal Injury Claim means any claim for damages, loss, indemnification, contribution, restitution or other relief, including punitive damages, that is related to bodily injury or another harm, including loss of consortium, society, or companionship, loss of support, personal injury or death, mental or emotional injury, risk or fear of disease or other injury, or costs of medical monitoring or surveillance and that is allegedly caused by or related to the claimant’s exposure to asbestos. “Personal injury claim” includes a claim made by or on behalf of the person who claims the injury or harm or by or on behalf of the person’s representative, spouse, parent, minor child, or other relative. “Personal injury claim” does not include a claim compensable by the injured patients and families compensation fund or a claim for compensatory benefits pursuant to worker’s compensation or veterans benefits.
Personal Injury Claim means a claim for damages for personal injury that is subject to the operation of Subsection 63G-7-604(1)(a) or (d).

  • Under Section 104 of the IRC, to the extent that a payment from the Plan Trust to a holder of an Asbestos Personal Injury Claim constitutes damages on account of personal physical injuries or physical sickness of such holder, such payment will not constitute gross income to such holder, except to the extent that the payment is attributable to medical expense deductions taken under Section 213 of the IRC for a prior taxable year.
