The Parties intend that implementation of this SCIA be consistent with and subject to existing law, including but not limited to the Colorado River Compact, the Upper Colorado River Basin Compact, the Colorado River Storage Project Act of 1956, and the Colorado River Basin Project Act of 1968.
Notwithstanding the immediately preceding exception, such amortization shall also apply to any adjustments in this component charge resulting from a change in the Project Interest Rate due to any refunding after January 1, 1986 on bonds issued under the Central Valley Project Act.
If any Party becomes concerned that there may be a claim or controversy under this Demand Management Storage Agreement or, specific to the Secretary, Section 601 of the Colorado River Basin Project Act of 1968 (43 U.S.C. § 1551), and all applicable rules and regulations promulgated thereunder, such Party shall notify all other Parties in writing, and shall in good faith meet to resolve such claim or controversy by mutual agreement prior to initiating any judicial or administrative proceeding.
For purposes of this Companion Agreement, the Upper Basin DCP includes the Agreement for Drought Response Operations at the Initial Units of the Colorado River Storage Project Act and the Agreement Regarding Storage at Colorado River Storage Project Act Reservoirs Under an Upper Basin Demand Management Program (“Demand Management Storage Agreement”) which are attached and incorporated herein as Attachments A1 and A2.
