Project NMGF means the Solar NMGF from which Subscriber purchases the Percentage Allocation;

  • CDG Host does not guarantee, and Subscriber acknowledges that CDG Host does not guarantee the amount of electrical energy the Project NMGF will produce or the monetary value of the Bill Credits.

  • In any Bill Period, CDG Host will have the right to adjust the Percentage Allocation allocated to Subscriber in order to maximize the Project NMGF allocations to Subscriber and the Project NMGF's other subscribers as permitted under the CDG Program, the Tariff, and applicable law, provided that the Percentage Allocation will not exceed the Subscriber’s historic annual kWh usage or forecasted usage if annual historic data is not available.

  • The Authorized Designee may transfer this Agreement to another Project NMGF, by sending written notice to Subscriber.

  • The Authorized Designee and the CDG Host do not guarantee, and Subscriber acknowledges that the Authorized Designee and the CDG Host do not guarantee, the amount of electrical energy the Project NMGF will produce or the monetary value of the Bill Credits.

  • Subscriber hereby consents to the Authorized Designee modifying the PercentageAllocation to maximize Project NMGF allocations to Subscriber and the Project NMGF’s other subscribers, p rovided such modifications comply, in all respects, with applicable law.

  • Subscriber agrees that it shall be responsible for all sales, use, or other similar taxes imposed upon the purchase and sale of the Percentage Allocation by any governmental authority having jurisdiction over Subscriber, the Project NMGF, or the CDG Host if any, and where such taxes are attributable to the sale of the Percentage Allocation to the Subscriber.

  • Subscriber agrees that it shall be responsible for all sales, use, or other similar taxes imposed uponthe purchase and sale of the Percentage Allocation by any governmental authority having jurisdiction over Subscriber, the Project NMGF, the Authorized Designee, or the CDG Host if any, and where such taxes are attributable to the sale of the Percentage Allocation to the Subscriber, except in cases where Subscriber is exempt from sale tax and produces proof of its tax exemption status.

  • The New York State Public Service Commission permits Subscribers to receive Bill Credits on their Electric Utility bill in consideration for purchasing the Percentage Allocation of the Project NMGF.

Related to Project NMGF

  • Project means the goods or Services described in the Signature Document or a Work Order of this Contract.

  • Project Water means water made available for delivery to the contractors by project conservation facilities and the transportation facilities included in the System.

  • The Project Plan means the document to be developed by the Supplier and approved by the Purchaser, pursuant to GCC Clause 19, based on the requirements of the Contract and the Preliminary Project Plan included in the Supplier’s bid. The “Agreed and Finalized Project Plan” is the version of the Project Plan approved by the Purchaser, in accordance with GCC Clause 19.2. Should the Project Plan conflict with the Contract in any way, the relevant provisions of the Contract, including any amendments, shall prevail.

  • Project Name means the name of the project stated in SCC.

  • Project Improvements means site improvements and facilities that are:

  • Environmental Infrastructure Facilities means Wastewater Treatment Facilities, Stormwater Management Facilities or Water Supply Facilities (as such terms are defined in the Regulations).

  • Project Property means the real property on or for which preconstruction service or construction work is or will be provided.

  • Project Company means Company incorporated by the bidder as per Indian Laws in accordance with Clause no 3.5.

  • Project Plan means the document to be developed by the Contractor and approved by WTL, based on the requirements of the Contract and the Preliminary Project Plan included in the Contractor’s bid. For the sake of clarity, the Agreed and Finalized Project Plan” refers to the version of the Project Plan submitted by the contractor after receiving the letter of Award and the same approved by WTL. The project plan may be changed/ modified during the course of the project. Should the Project Plan conflict with the provisions of the Contract in any way, the relevant provisions of the Contract, including any amendments, shall prevail.

  • Project Work means the work required to complete the Project.

  • Project Contract means any contract between the District or the Corporation and any contractor or vendor regarding the construction, production or other acquisition or installation of any part of an Acquisition Project.

  • Project Land means any parcel or parcels of land on which the project is developed and constructed by a promoter;
