Property assessment definition

Property assessment means a property assessment conducted in accordance with section 3746.04 of the Revised Code or a corrective action process or source investigation process under rule 1301:7-9-13 of the Ohio Administrative Code.

Property assessment means a written assessment of the number of acres on the Property that Owner warrants may be burdened by Conservation for conservation purposes in accordance with California Civil Code 815 and this Agreement, and which excludes any portion of the Property subject to any right of way, easement, encumbrance, or any other matter that prevents establishment of a Conservation Easement on that portion of the Property for conservation purposes in accordance with California Civil Code 8 15 and this Agreement, and which shall be attached hereto at Exhibit J.

Failure of Buyer to notify Seller of cancellation within the fifteen (15) business day period, or to conduct said inspection, shall operate as a waiver of Buyer’s right to terminate this Agreement on the basis of the Property Assessments under this Section 16. Buyer shall indemnify and hold harmless Seller from and against any loss or damage caused by the acts of negligence of Buyer or any person performing any Property Assessment.
