Qualified Mortgagee definition

Qualified Mortgagee means any Leasehold Mortgagee who notifies Lessor in writing of its name, its address for notices and the fact that it is a Leasehold Mortgagee and includes with such notice a copy of any Leasehold Mortgage by virtue of which it became a Leasehold Mortgagee.

Qualified Mortgagee is defined as:

Qualified Mortgagee means any Leasehold Mortgagee who notifies Lessor in writing of its name, its address for notices, and the fact that it is a Leasehold Mortgagee and includes with such notice a copy of any Leasehold Mortgage by virtue of which it became a Leasehold Mortgagee.

• Additionally, if the Foreclosure Transferee is a Qualified Mortgagee, such Qualified Mortgagee shall have the right to assign its interest under this Lease without the consent of Lessor and, upon such assignment, Lessor shall recognize the assignee as a substitute Lessee under this Lease and the Qualified Mortgagee shall be released of any further liability under the Lease.

• In the case of notices to a Qualified Mortgagee, to the address set forth in its most recent notice to Lessor.

• If a Qualified Mortgagee is prohibited by any process or injunction issued by any court or by reason of any action of any court having jurisdiction over any bankruptcy or insolvency proceeding involving Lessee from commencing or prosecuting the proceedings described above, then the 60-day period specified above for commencing such proceedings shall be extended for the period of such prohibition.

• At the option of the Qualified Mortgagee, the new lease may be executed by a designee of such Qualified Mortgagee, without the Qualified Mortgagee assuming the burdens and obligations of Lessee thereunder.

• As a precondition to exercising any rights or remedies as a result of any default or alleged default by Xxxxxx, Lessor shall deliver a duplicate copy of the applicable default notice to each Qualified Mortgagee concurrently with delivery of such notice to Lessee.

More Definitions of Qualified Mortgagee

Qualified Mortgagee means a Mortgagee of which the RDA has been given written notice, including such Mortgagee’s name and address.

Qualified Mortgagee means the mortgagee or mortgagees under or pursuant to a Qualified Mortgage.

Qualified Mortgagee is defined in Section 13.03.

Qualified Mortgagee means a Mortgagee of which Agency has been given written notice, including such Mortgagee’s name and address. A Qualified Mortgagee shall be a Mortgagee of public record as evidenced by a title report delivered to Agency.

The RDA shall be given written notice, including such Mortgagee’s previous developments, name and address which has been evaluated and verified as qualified by the selection committee. This will be evaluated through the selection criteria highlighted in Section III – Selection Process and Criteria, of the RFP document.

Qualified Mortgagee means any Leasehold Mortgagee who notifies Lessor in writing of its name, its address for notices and the fact that it is a Leasehold Mortgagee and includes with such notice a copy of any Leasehold Mortgage by virtue of which it became a Leasehold Mortgagee. Notwithstanding the foregoing or any other provision of this Lease to the contrary, Lessor will have no obligation to recognize more than three Leasehold Mortgagees as Qualified Mortgagees at any given time. If more than three Leasehold Mortgagees exist, then Lessee will notify Lessor in writing of the three Leasehold Mortgagees that Lessor should recognize. If Lessee fails to notify Lessor of the three Leasehold Mortgagees that Lessor should recognize, then Lessor will recognize the three first in time Leasehold Mortgagees that have notified Lessor.
