Real Property Encumbrances definition

Real Property Encumbrances means the Encumbrances over the Real Property disclosed in the Vitran Disclosure Letter;
Real Property Encumbrances means any encumbrance of any kind (meaning any pledge, mortgage, seizure, privilege, lien, usufruct, right of pre-emption, enjoyment or claim, easement, right of first refusal or any third party option right or any other encumbrance or security interest of any kind).

  • If Seller delivers a Non-Removal Notice to Buyer, then Buyer shall have until the date that is five (5) Business Days after the date that Buyer has received the Non-Removal Notice to notify Seller in writing that Buyer elects to either (A) nevertheless proceed with the transactions contemplated herein subject to such exceptions (in which event all such exceptions shall be deemed to constitute Permitted Real Property Encumbrances), or (B) terminate this Agreement.

Real Property Encumbrances means Encumbrances, rights of way, covenants, restrictions, rights of first refusal, easements, leases, subleases, preemptive rights, restrictions, encroachments and other burdens, options or encumbrances filed of record of any kind.
Real Property Encumbrances means all covenants, restrictions, easements and other matters of title recorded against or otherwise affecting all or any portion of Owned Real Property and set forth on SCHEDULE 11.1(C).
Real Property Encumbrances means the debt secured by the Business Real Property.
