The Concessionaire/Agency shall commence Reclamation and Remediation Works from its date of COD.
For the avoidance of doubt, this obligation applies to the Remediation Works, including after the transfer of the Contribution Land.
If the Expert decides that further Remediation Works need to be carried out (“Further Remediation Works”) then the Remediating Party will procure at its own expense that the Further Remediation Works are carried out as soon as reasonably practicable.
If the other Party fails to give such notification in writing within such period then it shall be deemed to be satisfied with the Remediation Works.
The Investor, however, shall not be obliged or held liable to reimburse Slovakia for any costs (whether factual, administrative or any other) of any works, including the Site Remediation Works that were done for the benefit of the Strategic Park and/or from which Slovakia, Nitra or any other third party, including any potential investors, may benefit, other than, or in respect of, the Investment Aid and/or the sale of the Site, the Expansion Land, the North Land and/or the South Land.
