Rentable Square Footage of the Premises definition

Rentable Square Footage of the Premises is deemed to be 3,315 square feet. The “Usable Square Footage of the Premises” is deemed to be 2,913 square feet. If the Premises include, now or hereafter, one or more floors in their entirety, all corridors and restroom facilities located on such full floor(s) shall be considered part of the Premises. Landlord and Tenant stipulate and agree that the Rentable Square Footage of the Building, the Rentable Square Footage of the Premises, and the Usable Square Footage of the Premises are correct and shall not be remeasured.
Rentable Square Footage of the Premises without representation, is deemed to be an aggregate of 24,029 rentable square feet (“RSF”). Landlord and Tenant stipulate and agree that the Rentable Square Footage of the Building and the Rentable Square Footage of the Premises are correct. The above rentable square footages are stipulated to apply throughout the Term (as hereinafter defined) of this Lease and shall not be subject to adjustment.
Rentable Square Footage of the Premises is deemed to be 20,585 square feet. If the Premises include one or more floors in their entirety, all corridors and restroom facilities located on such full floor(s) shall be considered part of the Premises. Rentable Square Footage of the Premises means approximately 1,373 square feet.

Rentable Square Footage of the Premises is deemed to be 31,019 square feet. If the Premises include, now or hereafter, one or more floors in their entirety, all corridors and restroom facilities located on such full floor(s) shall be considered part of the Premises. The exact Rentable Square Footage of the Premises shall be deemed to be as set forth in this Section 1.C; provided, however, within 30 days after the Commencement Date, Tenant may enlist its architect, at Tenant’s sole cost, to measure the Rentable Square Footage of the Premises using the Standard Method for Measuring Floor Area in Office Buildings ANSI Z65.1-1996 or successor standards, adopted by the Building Owners and Managers Association International (BOMA). If such measurement indicates that the Rentable Square Footage of the Premises is different by more than one percent (1%) of the number of square feet of Rentable Square Footage set forth in this Section 1.C, then Tenant may notify Landlord of Tenant’s architect’s calculation, and the parties, through reasonable good faith negotiations, shall endeavor to resolve such discrepancy. In the event the parties are unable to resolve such discrepancy in a timely manner, then Landlord’s architect for the Building and Tenant’s architect shall jointly appoint an independent architect to resolve such discrepancy and the determination of such independent architect shall be binding on both Landlord and Tenant. The fees of such independent architect shall be shared equally by Landlord and Tenant. Promptly following determination of the Rentable Square Footage of the Premises in accordance with this Section 1.C., the parties shall enter into an amendment to this Lease modifying the Rentable Square Footage of the Premises and the amount of the installments of Base Rent and other provisions as appropriate. Notwithstanding the foregoing, if such measurement of the Premises indicates a discrepancy of less than one percent (1%), then no change shall be made to this Lease.
Rentable Square Footage of the Premises is approximately 136,358 RSF, comprised of approximately 130,151 RSF in the Original Premises (consisting of approximately 126,795 RSF on Floors 3, 4 and 5 and approximately 3,356 RSF on the first Floor of the Building) and approximately 6,207 RSF in the First Additional Premises. If the Premises include, now or hereafter, one or more floors in their entirety, all corridors and restroom facilities located on such full floor(s) (but not partial floors) shall be considered part of the Premises. Common Area corridors and restroom facilities located on partial floors leased by Tenant shall not be included in the Premises, though they shall be available for use by Tenant in accordance with this Lease. The RSF of the Building and the RSF of the Premises shall be measured on or about the Delivery Date by Landlord's architect in accordance with the Building Owners and Managers Association (BOMA) International (ANSI.265-1-2010) standards. Tenant may at its expense have its architect verify such measurements by Landlord's architect and if Tenant's architect believes Landlord's architect is in error, notify Landlord of such belief. In the event Tenant's architect challenges such calculations by Landlord's architect, Tenant shall give written notice thereof to Landlord on or before sixty (60) days after receipt by Tenant of said measurements by Landlord's architect. In the event of such timely challenge and in the event Landlord's architect and Tenant's architect are not able to agree on the RSF of the Building and the Premises, Landlord's architect and Tenant' s architect shall select an independent architect to measure the RSF of the Building and the Premises and the independent architect's measurements shall be conclusive and binding on the parties. The fees and expenses of the independentarchitect shall be shared equally by the parties.
Rentable Square Footage of the Premises shall have the meaning set forth in Section 1.02.
Rentable Square Footage of the Premises is deemed to be 59,797 square feet. Within five (5) Business Days following the Commencement Date, Tenant may by written request to Landlord require that the Rentable Square Footage of the Premises be verified at Tenant’s sole cost by a space planner/designer reasonably acceptable to both Landlord and Tenant, utilizing BOMA Standard ANSI Z65.1-1996. If the Premises include, now or hereafter, one or more floors in their entirety, all corridors and restroom facilities located on such full floor(s) shall be considered part of the Premises. Landlord and Tenant stipulate and agree that the Rentable Square Footage of the Building hereinabove specified is correct and shall not be re-measured, and, unless the Rentable Square Footage of the Premises is re-measured as hereinabove provided, the Rentable Square Footage of the Premises set forth herein shall be deemed correct and shall not be remeasured. The single tenant full floor conversion factor used to calculate the Rentable Square Footage of the Premises is approximately 10.110%, and the multi-floor conversion factor for the Building is approximately 14.146%.
