Right to Counsel definition

Right to Counsel. Member understands that they should hire independent legal counsel, if Member does not understand any part of this agreement, or wishes independent legal advice.
Right to Counsel means that a tenant has the right to free counsel in certain fundamental legal proceedings, like eviction cases, if they choose. It does not mean that landlords lose their ability to evict tenants. It simply assures that if a tenant asks for legal counsel, the tenant may access legal information, advice, and a representative to speak on their behalf in eviction
Right to Counsel means nothing if people who cannot afford to hire an attorney receive late or inadequate representation. New York State fails to ensure the right to counsel for those of little means who appear in its courts.

Related to Right to Counsel

  • Legal counsel shall have the meaning assigned to such term in Section 2(b).

  • Refuse to Cooperate means to obstruct the collection or testing process; to submit an altered, adulterated or substitute sample; to fail to show up for a scheduled test; to refuse to complete the requested drug testing forms; or to fail to promptly provide specimen(s) for testing when directed to do so, without a valid medical basis for the failure. Employees who leave the scene of an accident without justifiable explanation prior to submission to drug and alcohol testing will also be considered to have refused to cooperate and will automatically be subject to discharge.

  • Defense Counsel means Xxxxxx, Xxxxx & Xxxxxxx LLP.

  • Instructions to Consultants (Section 2 of the RFP) means the document which provides shortlisted Consultants with all information needed to prepare their Proposals.

  • Consult or “consulting" means thoroughly reviewing and discussing the relevant facts and discretionary issues.

  • Independent Legal Counsel means an attorney or firm of attorneys, selected in accordance with the provisions of Section 1(c) hereof, who shall not have otherwise performed services for the Company or Indemnitee within the last three years (other than with respect to matters concerning the rights of Indemnitee under this Agreement, or of other indemnitees under similar indemnity agreements).

  • Counselor means a juvenile department counselor or a county juvenile probation officer.

  • Company U.S. Counsel means Hxxxxx and Bxxxx, LLP, with offices located at 30 Xxxxxxxxxxx Xxxxx, 00xx Xxxxx, Xxx Xxxx, Xxx Xxxx 00000.

  • Lead Counsel means the law firm of Xxxxxxxxx Xxxxxxxx Xxxxxx & Xxxxxxxxx LLP.

  • Certified counselor means an individual who is certified by a training program or certifying organization, approved by the director, that authenticates the competence of individuals who provide education and assistance to other individuals in connection with debt counseling and financial counseling functions.

  • Co-Lead Counsel means the law firms of Xxxxxxxxx Litowitz Xxxxxx & Xxxxxxxxx LLP and Bleichmar Xxxxx & Auld LLP.

  • Class Counsel means X. Xxxxxxxx Xxxxx of Xxxxxx X. Xxxxxx, A Professional Law Corp; Xxxxx X. Xxxxx of Xxxxx Xxxxx Xxxxxx Xxxxxxxxxxx Xxxxx & Xxxxxxxx LLP; Xxxxxxx X. Xxxx of Xxxx Xxxxxxxxxxx Xxxxx Xxxxxxx & Xxxx LLP; and Xxxxx Xxxxxx Xxxxxx of Xxxxxxxxx Xxxxxxx Xxxxx P.L.L.P.

  • Expert witness or “expert” means a person who is retained to render an opinion regarding an issue relevant to a case, whether or not the person actually testifies in court.

  • Indemnitors has the meaning given to such term in Section 6(h).

  • Special Counsel means one special counsel to the Holders, for which the Holders will be reimbursed by the Company pursuant to Section 4.

  • Legal Opinion means any legal opinion delivered to the Agent under Clause 4.1 (Initial conditions precedent) or Clause 29 (Changes to the Obligors).

  • Attorney-in-Fact means an agent under a power of attorney pursuant to chapter 633B or an attorney in fact under a durable power of attorney for health care pursuant to chapter 144B.
