Roche Patent Rights definition

Roche Patent Rights means the Patent Rights relating to the Compound and any Product that Roche or its Affiliates Control as of the Effective Date. The Roche Patent Rights are listed in Appendix 1.55 (a). For purposes of clarity, the Patent Rights identified in Appendix 1.55 (b) (“Excluded Patent Rights”) are specifically excluded from the Roche Patent Rights.
Roche Patent Rights means all Patent Rights Covering a Product that Roche Controls during the Agreement Term.
Roche Patent Rights means all Patents in the Territory listed on Appendix A, and any future Patents that claim priority from or the benefit of the filing date of any of the Patents listed in Appendix A, and including any and all extensions, supplementary protection certificates and the like with respect to any of the foregoing.

  • The Parties shall cooperate with each other in gaining patent term restorations, extensions and/or SPCs wherever applicable to such Roche Patent Rights.

More Definitions of Roche Patent Rights

Roche Patent Rights means as of the relevant time during the Term, all Patent Rights that are Controlled by ROCHE or any of its Affiliates that, at such time, claim or disclose ROCHE Know-how. ROCHE Patent Rights exclude Joint Patent Rights.
Roche Patent Rights means the patent applications and patents listed in Appendix 1, including, by way of example only, all divisionals, continuations, continuations-in-part, re-examinations, reissues, extensions, registrations, confirmations and supplementary or complementary certificates and the like with respect to any of the foregoing.
Roche Patent Rights means the patent applications and patents listed in Appendix 1.
Roche Patent Rights means (a) all Patent Rights that Roche and its Affiliates Controls as of the Effective Date or during the Agreement Term to the extent used by Roche or its Affiliates to perform activities under this Agreement (including Roche Sole IP and Roche’s interest in Joint IP) (but excluding Supplemental Studies unless BPM opts-in pursuant to Section 7.2), and (b) with respect to Program 2 and Program 4, any Patent Rights that Roche or its Affiliates uses in Exploiting any Licensed Products for Program 2 and Program 4 (as applicable) (but excluding Supplemental Studies unless Roche opts-in pursuant to Section 7.2), and in each case (a) and (b) that are necessary or useful to perform the activities under this Agreement. The Patent Rights identified in Appendix 1.114 (“Excluded Patent Rights”) are specifically excluded from the Roche Patent Rights.
Roche Patent Rights means all Patent Rights (i) Covering an Invention that ROCHE Controls and that relate to the discovery, manufacture, development or commercialization of a Product or (ii) Covering a Product. The term ROCHE Patent Rights include ROCHE Base Patent Rights.
Roche Patent Rights means the Roche Background Patent Rights and the Roche Product Patent Rights.
