The Borrower will not, nor will it permit any of its Subsidiaries to, cause or permit the occurrence of any event or condition that would result in any recourse to any Obligor under any Permitted SBIC Guarantee.
The Credit Parties, together with their “affiliates” (as that term is defined in Title 13, Code of Federal Regulations, § 121.103), do not presently engage in, and do not intend to engage in, any activities, nor does any Credit Party intend to use, directly or indirectly, the proceeds of any Advance for any purpose violative of the SBIC Regulatory Side Letter (if any).
