Secondary Field definition

Secondary Field means therapeutic, prophylactic, or diagnostic health care applications in humans that are not included in the Primary Field.

Secondary Field means the use or sale of Equivalent Products, including research and development in support thereof, provided however in respect of all Equivalent Products, Secondary Field excludes:

• During the Research Collaboration Term, neither DICERNA nor KHK will develop or commercialize any siRNA compound for any Program Target for use in the Secondary Field in the Territory, whether internally developed by such Party or in-licensed from, or out-licensed to, any Third Party, outside of this Agreement.

• If the parties have not agreed to establish such a collaboration within such * period, Symyx shall be free to engage in a collaboration in such Secondary Field with a Third Party, and in such event, such Secondary Field shall thereafter be excluded from both the Secondary Fields and the Fields.
