Seller Attestation means a Seller Notice with a written attestation or certification from Seller stating (a) that the Project (including each of the Customer Site(s)) is able to operate in a manner consistent with the Safety Requirements and/or which takes into account the Safety Remediation Plan, if a Remediation Event has occurred, and in addition (b) in the event of a Project Modification only, that the Project is Commercially Operable. The Seller Attestation shall be substantially in the forms attached hereto as Appendix VI-D, and in addition, Appendix VI-B in the case of a Project Modification.

Related to Seller Attestation

  • Attestation means a Transfer Certificate or Certification by Seller as the Certification Authority in form and substance as agreed to by the Parties separate and apart from the Product Order, examples of which for voluntary and potentially other Applicable Programs is attached as Exhibit C and D.
