The obligation of the Company to allot and issue the Series G Preferred Shares subscribed by the Investor hereunder to the Investor at the Closing is subject to the fulfillment by the Investor, or unless otherwise waived in writing by the Company, of the conditions as set forth in EXHIBIT H.
