Servicing Claim definition

Servicing Claim means an enforceable and liquidated money claim of a Company against (i) the trustee of MBS backed by Serviced Loans, or the holder of serviced Whole Loans, in respect of which such Company made the related Servicing Receivable Advance(s), (ii) such Serviced Loans’ Customers and their accounts, (iii) an insurer of such Serviced Loans or (iv) another identified Person, for reimbursement of the relevant type(s) of Servicing Receivable Advance(s) made by such Company pursuant to its obligation or right as Servicer to do so under a Servicing Agreement.

Servicing Claim means an enforceable and liquidated money claim of a Company against (i) the trustee of Structured Securities backed by Serviced Loans, or the holder of serviced Whole Loans, in respect of which such Company made the related Periodic Advance(s), (ii) such Serviced Loans' Customers and their accounts, (iii) an insurer of such Serviced Loans or (iv) another identified Person, for reimbursement of the relevant Periodic Advance(s) made by such Company pursuant to its obligation or right as Servicer to do so under a Servicing Agreement.

More Definitions of Servicing Claim

Servicing Claim. As defined in (i) SECTION 8.03(A) hereof with respect to Fairbanks and Wilshire and (ii) any claims, penalties, fines, forfeitures, damages, liabilities, losses and expenses, including reasonable attorney's fees subject to indemnification under Section 5.02 of the GreenPoint Servicing Agreement with respect to GreenPoint.

Related to Servicing Claim

  • Mortgage Loan File As defined in Section 2.1(b) and any additional documents required to be added to the Mortgage Loan File pursuant to this Agreement.
