Settlement Term Sheet definition

Settlement Term Sheet means the Settlement Term Sheet included as Schedule 9 (Settlement Term Sheet).

Settlement Term Sheet means that certain Settlement Term Sheet, dated as of April 28, 2006, by and among the Debtors (subject to the approval of the Bankruptcy Court), the Asbestos Claimants’ Committee, the Future Claimants’ Representative, the Official Representatives, the Ad Hoc Equity Holders’ Committee and the Ad Hoc Bondholders’ Committee. A true and correct copy of the Settlement Term Sheet is attached as an exhibit to the Plan Support Agreement, which is appended to the Disclosure Statement as Appendix G.

• Notwithstanding the foregoing, this Settlement Agreement, the Settlement Term Sheet and any acts performed and/or documents executed in furtherance of or pursuant to this Settlement Agreement or the Settlement Term Sheet may be used in any proceedings as may be necessary to effectuate the provisions of this Settlement Agreement.

• If this Agreement is terminated or fails to become effective, then the Parties shall be restored to their respective positions in the Action as of the moment just prior to the signing of this Agreement, and the Settlement Term Sheet entered into between CTBI and the Named Plaintiff shall be canceled, null and void.

More Definitions of Settlement Term Sheet

Settlement Term Sheet means the terms set forth in Exhibit A of the Equity Commitment Agreement.
