  • MOF hereby undertakes to allocate fishing opportunities to the COMPANY’s fishing vessel(s) to access Seychelles waters and to engage in fishing activities in accordance with this Agreement and Annex thereto.

  • For the purposes of this Annex, the duration of a trip by a Mauritius vessel shall be defined as follows: ⎯ the period elapsing between entering and leaving Seychelles waters, ⎯ the period elapsing between entering Seychelles waters and a transhipment, or ⎯ the period elapsing between entering Seychelles waters and a landing in Seychelles.

  • During the period covered by this Agreement, MOF and the COMPANY shall cooperate to monitor the evolution of the resources in Seychelles waters and support the assessment work carried out by the IOTC.

  • With regards to the Vessel Monitoring System, all Mauritius vessels fishing, or intending to fish, in the Seychelles fishing zones within Seychelles waters under this Agreement, shall comply with all the provisions set out in Appendix 5.

  • A Mauritius vessel may fish, or do any act preparatory to fishing in Seychelles waters provided it is in possession of a valid fishing authorization issued by the Seychelles authority pursuant to this Agreement.

  • The Parties undertake to ensure that all nominative data relating to fishing activities in Seychelles waters under this Agreement, including data collected by observers, are processed in accordance with confidentiality and data protection principled under the applicable law of Seychelles.

  • Failure to observe the provisions of the Agreement and its Annexes and Appendices or the applicable laws and regulations of Seychelles relating to the conservation and management of marine living resources in Seychelles waters is an offence and shall be liable to a sanction in accordance with the laws of Seychelles.

  • The Parties shall ensure that only aggregated data related to fishing activities in the Seychelles waters shall be made available in the public domain in line with applicable IOTC resolution.

  • Transhipment at sea in Seychelles waters is prohibited, and any person infringing this provision shall be liable to the enforcement measures provided for by Seychelles legislation.

Related to Seychelles waters

  • Company’s wharf means the wharf to be constructed by the Company pursuant to this Agreement for the shipment of iron ore from the mineral lease or (except for the purposes of the definition of “harbour”) other the temporary wharf for the time being approved by the Minister as the Company’s wharf for the purposes hereof during the period to which such approval relates;

  • Transportation Company means any organization which provides its own or its leased vehicles for transportation or which provides freight forwarding or air express services.

  • Raffle means a lottery in which the prize is won by (i) a random drawing of the name or

  • Harbour Master means the ABP Harbour Master or Dock Master for the Port (as appropriate) or their authorised representative;

  • Navigable waters ’ means the waters of the United States, including the territorial sea;

  • inland waters means the navigable waters of the United States shoreward of the navigational demarcation lines dividing the high seas from harbors, rivers, and other inland waters of the United States and the waters of the Great Lakes on the United States side of the International Boundary;

  • Heliport means an aerodrome or a defined area on a structure intended to be used wholly or in part for the arrival, departure and surface movement of helicopters;

  • Ecology means the Washington State Department of Ecology.

  • Offshore waters means marine waters of the Pacific Ocean

  • harbour means the port or harbour at or near Port Hedland or such other port or place mutually agreed on and serving the Company’s wharf;

  • Freeboard means a factor of safety usually expressed in feet above a flood level for purposes of floodplain management. "Freeboard" tends to compensate for the many unknown factors that could contribute to flood heights greater than the height calculated for a selected size flood and floodway conditions, such as wave action, blockage of bridge or culvert openings, and the hydrological effect of urbanization of the watershed.

  • Ocean transportation means any transportation aboard a ship, vessel, boat, barge, or ferry through international waters.

  • Campfire means a small outdoor fire intended for recreation or cooking not including a fire intended for disposal of waste wood or refuse.

  • Fertilizer means any substance or mixture of substances that contains one or more recognized plant nutrients and promotes plant growth, or controls soil acidity or alkalinity, or provides other soil enrichment, or provides other corrective measures to the soil.

  • LHSIA means the Local Health System Integration Act, 2006, and the regulations made under it, as it and they may be amended from time to time;

  • River means a flowing body of water or a portion or tributary of a flowing body of water, including streams, creeks, or impoundments and small lakes thereon.

  • Coastal waters means those waters of Long Island Sound and its harbors, embayments, tidal rivers, streams and creeks which contain a salinity concentration of at least five hundred parts per million under low flow conditions.

  • Oxides of nitrogen means the sum of the volume mixing ratio (ppbv) of nitrogen monoxide (nitric oxide) and nitrogen dioxide expressed in units of mass concentration of nitrogen dioxide (μg/m3);

  • Graywater means untreated wastewater that has not been contaminated by any toilet discharge, has not been affected by infectious, contaminated, or unhealthy bodily wastes, and does not present a threat from contamination by unhealthful processing, manufacturing, or operating wastes. "Graywater" includes, but is not limited to, wastewater from bathtubs, showers, bathroom washbasins, clothes washing machines, and laundry tubs, but does not include wastewater from kitchen sinks or dishwashers. Health and Safety Code Section 17922.12.

  • Cyberbullying means any form of communication by electronic act that is sent with the purpose to:

  • Mausoleum means a building or other aboveground structure that is affixed to land and is a permanent repository for human remains.

  • Shorelands or "shoreland areas" means those lands extending landward for two hundred feet in all directions as measured on a horizontal plane from the ordinary high water mark; floodways and contiguous floodplain areas landward two hundred feet from such floodways; and all wetlands and river deltas associated with the streams, lakes, and tidal waters which are subject to the provisions of this chapter; the same to be designated as to location by the department of ecology.
