Specified Acts definition

Specified Acts means the specified acts referred to in the “Intellectual Property, Moral Rights and Project Results” clause of this Agreement;
Specified Acts means harassment, abuse, discrimination or retaliation of any kind (including sexual, racial, gender, sexual orientation, disability or age-related harassment, abuse or discrimination).
Specified Acts means sexual intercourse, cunnilingus, fellatio, buggery, bestiality, masturbation, urination or defecation, or the bonding, flagellation, mutilation, maiming or murder of one or more human beings.

Examples of Specified Acts in a sentence

  • The Parties will use their best endeavours to arrange for each of their authors of Research Material or Incorporated Material to provide written consent to the Specified Acts as may be required by the NHMRC in accordance with clauses 12.6, 12.7 and 12.8 of the NHMRC Funding Agreement.

  • The Initial Grants are also subject to certain provisions of this Agreement, and the Agreement re Specified Acts being entered into between the Company and Executive concurrently with this Agreement in the form of Exhibit B to this Agreement (the “Agreement re Specified Acts”).

  • For the purposes of this Clause 18.2 (Specified Acts), Agreement Material includes any Pre-existing Recipient Material and Third Party Material to the extent that it is included in, forms part of or is attached to the Agreement Material.

  • Executive also acknowledges the Agreement re Specified Acts entered into between Executive and the Company in connection with the inception of his employment, which remains in full force and effect.

  • Except as expressly provided herein or in the Agreement re Specified Acts or in another agreement between the Company and Executive, the Severance Package shall not be subject to any duty to mitigate damages by Executive, nor any set off or reduction due to Executive’s post-termination employment, provided such post-termination employment does not contravene any agreement between the Company and Executive.


More Definitions of Specified Acts

Specified Acts means the use, reproduction, adaptation or exploitation of Material in conjunction with the Contract Material.
Specified Acts means any of the following acts or omissions by or with the authority of Curtin or the Commonwealth of Australia in relation to the Material:
Specified Acts means those acts or omissions by or on behalf of Us which would, but for this clause 19, infringe the author's right of attribution of authorship or the author's right of integrity of authorship, but excludes acts or omissions which would infringe the author's right not to have authorship falsely attributed.
Specified Acts means classes or types of acts or omissions performed by or on behalf of AusAID which would infringe an author’s right of attribution, or integrity, of authorship but does not include those which would infringe an author’s right not to have authorship falsely attributed.
Specified Acts means any of the following types of acts or omissions: a. directly or indirectly recording a Performance; b. using, reproducing, modifying, adapting, publishing, distributing, performing, broadcasting, communicating or exploiting all or any part of the Activity Material or Existing Material, with or without attribution of authorship or performership; c. supplementing the Activity Material or Existing Material with any other Material; d. using the Activity Material or Existing Material in a different context to that originally envisaged; e. releasing the Activity Material or the Existing Material to the public under an Open Access Licence; and f. any other acts or omissions specified in Item B of the Schedule in relation to the Activity, but does not include false attribution of authorship or performership. For the avoidance of doubt, ‘Activity Material’ and ‘Existing Material’ may include a Performance or a recording of a Performance; Specified Personnel means, in respect of an Activity, any natural person who is a member of Your Organisation Personnel and is specified in Item J of the Schedule for that Activity and includes any replacement Specified Personnel who are approved in accordance with clause 4.3 [Your Organisation’s Personnel and Specified Personnel] for that Activity; Subcontractor means, in respect of an Activity, any contractor, person or organisation who is engaged by Your Organisation to undertake any part of the Activity and ‘Subcontract’ means the written agreement between Your Organisation and the Subcontractor; Sub-subcontractor means, in respect of an Activity, any contractor, person or organisation who is engaged by a Subcontractor (or another subcontractor of the Subcontractor) to undertake any part of the Activity and ‘Sub-subcontract’ means the written agreement under which that contractor, person or organisation is so engaged; Supplementary Conditions means, in relation to an Activity, those Supplementary Conditions set out, or referred to, in Annexure A of the Schedule in respect of the Activity; Term means the period set out in clause 1.3 [Term of the Agreement];
Specified Acts means any of the following types of acts or omissions: a. using, reproducing, modifying, adapting, publishing, distributing, broadcasting, Defined term Meaning of defined term communicating or exploiting all or any part of the Activity Material or Existing Material, with or without attribution of authorship; supplementing the Activity Material or Existing Material with any other Material; using the Activity Material or Existing Material in a different context to that originally envisaged; releasing the Activity Material or the Existing Material to the public under an Open Access Licence; and any other acts or omissions specified in Item B of the Schedule in relation to the Activity, but does not include false attribution of authorship; Specified Personnel means, in respect of an Activity, any natural person who is a member of Your Organisation Personnel and is specified in Item J of the Schedule for that Activity and includes any replacement Specified Personnel who are approved in accordance with clause 4.3 [Your Organisation’s Personnel and Specified Personnel] for that Activity; Subcontractor means, in respect of an Activity, any contractor, person (other than a Client) or organisation who is engaged by Your Organisation to undertake any part of the Activity and ‘Subcontract’ means a written agreement between Your Organisation and the Subcontractor; Sub-subcontractor means, in respect of an Activity, any contractor, person or organisation who is engaged by a Subcontractor (or another subcontractor of the Subcontractor) to undertake any part of the Activity and ‘Sub-subcontract’ means the agreement under which that contractor, person or organisation is so engaged; Supplementary Conditions means, in relation to an Activity, those Supplementary Conditions set out, or referred to, in Annexure A of the Schedule in respect of the Activity; Term means the period set out in clause 1.3 [Term of the Agreement] including any extension effected Defined term Meaning of defined term under that clause; Undepreciated means, in relation to an Asset, the value of the Asset that has not been depreciated in accordance with Australian Accounting Standards; and
