Anything to the contrary herein or elsewhere notwithstanding, in no event shall Borrower have any liability or other obligation under or with respect to the Sponsor Guaranty, the Equity Owner Guaranty or the Borrower GP Guaranty.
The Landlord requires, as a condition of this lease, a binding Continuing Parental or Sponsor Guaranty (the “Guaranty”), which Guaranty constitutes inducement for the granting of this Lease by Landlord.

Nothing in this Amendment extinguishes, novates or releases any right, claim, or entitlement of Agent and/or any of the Lenders created by or contained in the Sponsor Guaranty and Put Agreement or any of the other Loan Documents nor is any Sponsor Guarantor released from any covenant, warranty or obligation created by or contained herein or therein.
The Sponsor Guaranty is in full force and effect and is a legal, valid, binding and enforceable obligation of the Sponsor except as enforcement may be limited by applicable bankruptcy, insolvency, reorganization, moratorium and other Laws affecting creditors’ rights generally and except insofar as the availability of equitable remedies may be limited by applicable Law.
