Subject Xxxxx definition

Subject Xxxxx means all xxxxx now located on the Subject Lands (whether fully drilled and completed or not) or hereafter drilled on the Subject Lands, and (unless production therefrom is expressly excluded by the terms of the description on Exhibit "A") any other xxxxx now or hereafter located on lands or leases pooled, communitized or unitized with the Subject Lands or the Subject Interests.

Subject Xxxxx has the meaning referred to in Recital B of this Agreement.

Subject Xxxxx means the oil and gas xxxxx described in Exhibit "A" attached hereto as such Exhibit may be amended from time to time as provided herein.

Examples of Subject Xxxxx in a sentence

• The Developed Properties Net Profits Interest shall apply to all such renewals, extensions, modifications, amendments and supplements of the Leases (but only as to Developed Properties Subject Xxxxx and to Targeted Formations covered by the predecessor lease and in which Grantor had an interest under the predecessor lease).

• Upon Grantee's written request, Grantor shall furnish appropriate "back up" information for the JIB's, including, but not limited to all third party invoices, field tickets and daily work and cost summaries identifying any work performed, or cost incurred, on the Subject Xxxxx.

• Grantor shall have an unequivocal right to abandon a Subject Interest, or any part thereof if such abandonment is necessary for health, safety or environmental reasons, or the Subject Minerals that would have been produced from the abandoned Subject Interest would otherwise be produced from Subject Xxxxx located on the remaining Subject Interests.

• It is expressly agreed that Force Majeure shall not include the level of market prices being offered and/or received by Grantor (or by the operator of a Subject Well if not Grantor) for the sale of Hydrocarbons produced from the Subject Xxxxx.

• The Contractor, under the direction and to the satisfaction of ODNR, shall also search the public records to determine the lienholders on and holders of security interests in equipment appurtenant to each of the Subject Xxxxx.

More Definitions of Subject Xxxxx

Subject Xxxxx means (a) with respect to all Subject Interests other than the Xxxx-Xxxxxxx Production Payment, any and all xxxxx now located on the Leases or hereafter drilled on the Leases, and any other xxxxx now or hereafter located on lands, waterbottoms or leases pooled, communitized or unitized with the Leases, from the surface to the total depth to which any such well or xxxxx may be drilled, including, without limitation, the xxxxx identified on Exhibit A, and (b) with respect to the Xxxx-Xxxxxxx Production Payment, those xxxxx specified in Exhibit A for the HHOC Properties, and any subsequently drilled "Xxxxx" under the conveyance of the Xxxx-Xxxxxxx Production Payment and amendments thereto described in Exhibit A. "Taxes" means all ad valorem, property, occupation, gathering, pipeline regulating, windfall profit, severance, gross production, energy, Btu, excise and other taxes and governmental charges and assessments imposed on the Subject Interests or the Overriding Royalty, including the Overriding Royalty Hydrocarbons, other than income taxes. "Termination Time" is defined in Section 1.03 hereof. "Working Interest" means the percentage interest in oil and gas leaseholds, including working interests, operating rights interests or other expense-bearing interests, and mineral fee or ownership interests. ARTICLE III MISCELLANEOUS SECTION 3.01.

Subject Xxxxx means the Xxxxx defined in the Assignment and Agreement. "Xxxxxx County Production Payment" means collectively (a) the "Production Payment" reserved by Grantor in Part II of the Assignment and Agreement, and (b) the "Production Payment" conveyed to Grantor in Part II of the InterCoast Conveyance. "Taxes" means all ad valorem, property, occupation, gathering, pipeline regulating, windfall profit, severance, gross production, energy, Btu, excise and other taxes and governmental charges and assessments imposed on the Subject Properties, the Subject Interests or the Production Payment, other than income taxes. "Termination Time" has the meaning set forth in Section 1.03 above. <PAGE> 49 "Working Interest" means the percentage undivided interest in oil and gas leaseholds, including working interests, operating rights interests or other expense-bearing interests and mineral fee or ownership interests. Subject Xxxxx means those oil and gas xxxxx (or proposed xxxxx or locations) listed in Exhibit B hereto.

Subject Xxxxx means all of Grantor’s right, title and interest in and to all xxxxx producing or capable of producing Hydrocarbons and all service xxxxx, now or hereafter located on the Subject Interests (whether fully drilled and completed or not), including without limitation, the xxxxx described or referred to on Exhibit A attached hereto.

Subject Xxxxx means all xxxxx identified in the Property Exhibit.

Subject Xxxxx means all xxxxx now located on the Subject Lands (whether fully drilled and completed or not) or hereafter drilled on the Subject Lands, and any other xxxxx now or hereafter located on lands or leases pooled, communitized or unitized with the Subject Interests.

Subject Xxxxx shall have the meaning given to such term in the Conveyance.
