This Agreement, the Subsidiary Guaranty, and all Loans and all other monetary obligations hereunder and thereunder, are hereby expressly designated as "Designated Senior Indebtedness", as that term is defined in the RTC Convertible Subordinated Indenture and in the RTC Convertible Subordinated Guaranty.
All communications and notices hereunder shall be given as provided in the Restructuring Agreement or, as the case may be, the Subordinated Guaranty Agreement.
