Timely completion definition

Timely completion means the ex parte review will occur by the 15th day of the month in which their Adoption Assistance Medicaid is to be terminated. DCF will send a report to Plaintiffs’ counsel by the 20th of each following month for the term of this agreement and the report shall include all Adoption Assistance Medicaid terminations that have been received for the month prior, less the number of the following individuals: those receiving some type of Medicaid or SSI; those individuals who have been denied Medicaid eligibility and provided notice of denial; and those individuals who are deceased. This report will be titled “Ex Parte Review Monthly Data – Subgroup One” and will not include any personally identifying beneficiary information. After the initial report, the following reports will include the results of a review of a random sample of 50% of cases received in the previous reporting period, but no more than 100 cases each month. Of these cases, DCF will report whether the ex parte review was completed timely; whether the Ex Parte Reviewee was provided notice of the result; and the final outcome of each case, i.e., whether Medicaid was terminated, continued Medicaid, or enrolled in Medically Needy. If, at any time prior to the expiration of this Agreement, reports provided by DCF indicate that DCF has timely completed no less than 85% of the ex parte review in this subgroup for any three months, DCF’s reporting obligations under this subsection shall cease.

If the completion of the Finish Work is delayed due to any act or omission by Tenant or Tenant’s Visitors, including, but not limited to, delays due to changes in or additions to the Finish Work requested by Tenant, delays in submission of information or estimates, delays in giving authorizations or approvals, or delays due to the postponement of any work at the request of Tenant, then the date set forth in paragraph (7) of the Basic Lease Provisions on which Tenant actually begins to pay Basic Rent will be accelerated by the number of days of delay caused by Tenant and Tenant’s Visitors (any such delay being referred to herein as a “Tenant Delay”).

  • Pre-commissioning means the testing, checking, and any other required activity that may be specified in the Technical Requirements that are to be carried out by the Supplier in preparation for Commissioning of the System as provided in GCC Clause 26 (Installation).
