The Producer will be required to provide the following undertakings to the LCHA Counterparty under the LCHA in relation to this prohibition: (a) 'Double claim' prohibition: The Producer shall not claim: (i) LCHA payments for volumes in respect of which Renewable Transport Fuel Certificates have been claimed under the RTFO Scheme; or (ii) Renewable Transport Fuel Certificates under the RTFO Scheme in respect of volumes which have been subsidised under the LCHA.
A further complicating factor is national and supranational sustainability regulations, such as the UK’s Renewable Transport Fuel Obligation (RTFO) and the EU’s Renewable Energy Directive (RED II), which may have differing criteria and definitions of sustainability.
Participation Undertakings The LCHA will permit the Producer to claim under the LCHA and also participate under the RTFO Scheme and therefore receive Renewable Transport Fuel Certificates for hydrogen produced by the Facility.
A RTFO Volume is an Invoiced Volume to Relevant Offtaker in respect of which Renewable Transport Fuel Certificates are claimed under the RTFO Scheme.
In the UK, DfT have encouraged the deployment of waste/residue-derived biofuels and renewable fuels of non-biological origin through double counting under the Renewable Transport Fuel Obligation (RTFO), and inclusion of aviation fuels within the RTFO ‘development fuels’ sub-target.
