  • Each of the Institutional Investors shall use its reasonable best efforts to prosecute the intervention, to support the Settlement, and to obtain Final Court Approval of the Settlement Agreement and entry of the Trustee Findings Order.

  • During the period during which Final Court Approval is being sought, the Accepting Trustees, the LBHI Debtors, and the Institutional Investors shall each be obligated to use their reasonable best efforts to obtain Final Court Approval of the Settlement and the entry of the Trustee Findings Order so long as there has been no material breach of this Settlement Agreement.

  • Trustee Functions means the functions set out in paragraph 6;

  • Escrow Trustee means the bank or trust company designated by the Fiscal Officer in the Certificate of Award as the initial escrow agent with respect to the Refunded Bonds under the Escrow Agreement and until a successor Escrow Trustee shall have become such pursuant to the provisions of the Escrow Agreement and, thereafter, "Escrow Trustee" shall mean the successor Escrow Trustee.

  • Property Trustee Account has the meaning set forth in Section 3.8(c).

  • Owner Trustee means Wilmington Trust Company, a Delaware trust company, not in its individual capacity but solely as owner trustee under this Agreement, and any successor Owner Trustee hereunder.

  • Lead Depositor means the Depositor under the Lead Securitization Servicing Agreement.

  • Related Trustee Means the trustee under the Related Pass Through Trust Agreement.

  • Lead Servicer means the master servicer designated under the Note A-1 PSA.

  • Lead Trustee means (a) during the period from and after the Note A-2 Securitization Date and prior to the Note A-1 Securitization Date, the Note A-2 Trustee and, (b) from and after the Note A-1 Securitization Date, the trustee designated under the Note A-1 Securitization.

  • Trustee means any person, including the founder of a trust, to whom property is bequeathed in order for such property to be administered for the benefit of another person.

  • Co-Trustee has the meaning set forth in the Basic Servicing Agreement.
