Water Delivery Guarantee definition

Water Delivery Guarantee means the water delivery guarantee set forth in Section 12. “Water Treatment Guarantee” means the water treatment guarantee set forth in Section 14.
Water Delivery Guarantee has the meaning specified in subsection SECTION 12.3(C) (Water Delivery Guarantee; Liquidated Damages).

  • The Agency and District will each obtain insurance, to the extent available, to secure their performance under the Agreement, including but not limited to the Water Delivery Guarantee, the Water Availability Guarantee, and the Water Treatment Guarantee, as well as general liability insurance on all facilities.

  • Nothing in this Section shall limit the DBOM Contractor’s right to Uncontrollable Circumstance relief under subsection 12.3(L) (Insufficiency of Sourced Seawater Supply) in the event that the Sourced Seawater Xxxxx, when operated and maintained by the DBOM Contractor in accordance with the Contract Standards, do not produce a sufficient amount of Sourced Seawater to enable the DBOM Contractor to meet the Water Delivery Guarantee.

  • Such adjusted Water Delivery Guarantee shall become effective in the month immediately following the month in which the BWS delivers notice pursuant to this subsection and shall remain in effect until further notice from the BWS; provided, however, that any adjusted Flow Rate pursuant to this subsection shall remain in effect for a minimum 60-day period, unless the parties agree to a shorter duration, in writing.

  • In the event the BWS adjusts the Flow Rate pursuant to subsection 12.3(G) (BWS Right to Adjust the Water Delivery Guarantee), then the Chemicals Element specified in the preceding sentence shall be reduced by: (1) $200,000.00 during long-term operation at 0.85 MGD; and (2) $400,000.00 during long-term operation at 0 MGD.

  • Product Water deliveries shall be measured at the Product Water Flow Meter for purposes of determining compliance with the Water Delivery Guarantee.

  • Typically, some key areas of performance guarantees are treatment (Product Water Quality or Meeting Discharge Permit Standards), water quantity delivered (Product Water Delivery Guarantee), production or treatment efficiency, and limits to any hydraulic transients in the water conveyance system.

Related to Water Delivery Guarantee

  • Subsidiary Guarantee means any guarantee of the obligations of the Issuers under this Indenture and the Notes by any Subsidiary Guarantor in accordance with the provisions of this Indenture.

  • Note Guarantee means the Guarantee by each Guarantor of the Company’s obligations under this Indenture and the Notes, executed pursuant to the provisions of this Indenture.

  • Subsidiary Guaranty is defined in Section 9.7(a).

  • CONSTRUCTION GUARANTEE means a guarantee at call obtained by the contractor from an institution approved by the employer in terms of the employer's construction guarantee form as selected in the schedule

  • Guaranteed asset protection waiver means that term as defined in section 3 of the guaranteed asset protection waiver act.

  • Limited Guarantee has the meaning set forth in the Recitals.

  • Subsidiary Guarantee Agreement means a Subsidiary Guarantee Agreement substantially in the form of Exhibit B, and all supplements thereto made by the Subsidiary Guarantors in favor of the Administrative Agent for the benefit of the Lenders.

  • Capital Securities Guarantee means the guarantee agreement that the Company enters into with Wilmington Trust Company, as guarantee trustee, or other Persons that operates directly or indirectly for the benefit of holders of Capital Securities of the Trust.

  • Guarantee used as a verb has a corresponding meaning.

  • Guaranty means, with respect to any Person, any obligation (except the endorsement in the ordinary course of business of negotiable instruments for deposit or collection) of such Person guaranteeing or in effect guaranteeing any indebtedness, dividend or other obligation of any other Person in any manner, whether directly or indirectly, including (without limitation) obligations incurred through an agreement, contingent or otherwise, by such Person:

  • Warrant Indenture means the warrant indenture to be entered into on or before the Closing Date between the Warrant Agent and the Corporation in relation to the Warrants, as amended from time to time;
