No action for damages lies or may be instituted against present or past Council, or members, employees, servants or agents of either We Wai Kai Nation or Council: for anything said or done or omitted to be said or done by that person in the performance or intended performance of the person's duty or the exercise of the person's authority; or for any alleged neglect or default in the performance or intended performance of the person's duty or the exercise of the person's authority.
Where any federal act or regulation or provincial act or regulation or any other We Wai Kai Nation law may apply to any matter covered by this Law, compliance with this Law shall not relieve a person from also complying with the provisions of the other applicable act, regulation or law.

Offences created under this Law constitute offences punishable on summary conviction for the purposes of subsection 22(1) of the First Nations Land Management Act, the enforcement of which may be prosecuted pursuant to this Law and the We Wai Kai Nation Enforcement and Prosecution Law.
One or more We Wai Kai Nation Residents may present the Registrar with a written complaint against a Residency Permit holder who is over the age of 12 years containing details as to why the behavior of that individual is a threat to the health, safety or welfare of other Residents on We Wai Kai Lands.

For greater certainty, nothing in this Law shall be construed so as to abrogate or derogate from any existing aboriginal or treaty rights of We Wai Kai Nation under section 35(1) of the Constitution Act, 1982, or their rights under the United Nations Declaration on the Rights of Indigenous Peoples.
