WHS Law means the Work Health and Safety Act 2011 (Cth) and any legislative instruments executed under that Act.
The Recipient must in carrying out its obligations under this Agreement, comply, and use reasonable endeavours to ensure that its subcontractors comply, with the provisions of all relevant statutes, regulations, by-laws and requirements of any Commonwealth, State, Territory or local authority including those arising under a WHS Law in respect of occupational health and safety.
Note: You must also manage risks to the health and safety of workers when undertaking transport activities in the workplace when the “wheels are stopped” – for example, packing, loading, restraining and unloading activities, and the repairs and maintenance of heavy vehicles, in accordance with your duties under the primary WHS Law in the jurisdiction/s in which you operate.
The Developer acknowledges that it is the Principal Contractor under WHS Law for the Works unless and until such time that the Developer engages a person to construct the Works, or engages another person conducting a business, or undertaking, to be the Principal Contractor for the Works, and authorises the person to have management or control of the workplace relating to the Works and to discharge the duties of a Principal Contractor under WHS Law.
