WORKS AND/OR EQUIPMENT definition

WORKS AND/OR EQUIPMENT means the industrial equipment and related spare parts to be delivered by the CONTRACTOR to the BUYER under any CONTRACT. The WORKS AND/OR EQUIPMENT expressly include:

Examples of WORKS AND/OR EQUIPMENT in a sentence

  • This detailed time schedule shall fully comply with the CONTRACTUAL TIME SCHEDULE itself and include all steps and stages required for the due, proper and timely delivery of the WORKS AND/OR EQUIPMENT.

  • Except otherwise expressly stipulated in a CONTRACT, the price of the WORKS AND/OR EQUIPMENT is fixed and is not subject to any revision.

  • Moreover, the CONTRACTOR shall provide the BUYER on a regular basis with a progress report on the studies, procurement, manufacture and/or performance of the WORKS AND/OR EQUIPMENT as well as a statement of all faced problems and corresponding corrective actions and measures carried out or proposed in relation thereto.

  • Moreover, any payment made by the BUYER shall not imply that the BUYER waives any of its rights nor that the BUYER accepted the WORKS AND/OR EQUIPMENT or any part thereof.

  • All TESTS in relation to the WORKS AND/OR EQUIPMENT (whether load/hot TESTS or no-load/cold TESTS) shall be performed by the CONTRACTOR.

  • The CONTRACTOR shall, for the duration of this suspension, maintain in good condition the WORKS AND/OR EQUIPMENT already executed and/or stored on the SITE, unless the BUYER expressly release in writing the CONTRACTOR from this obligation.All additional expenses and costs incurred by the CONTRACTOR as a result of the BUYER’s instructions pursuant to this Clause shall be (i) determined without undue delay and specified in a mutual agreement signed by both PARTIES and (ii) borne by the BUYER.

  • The CONTRACTOR shall then, within the shortest time period agreed upon with the BUYER, remedy at its own expenses all defects and reservations noted before asking the BUYER for any new acceptance.Any non-acceptance of the WORKS AND/OR EQUIPMENT for reasons due to the CONTRACTOR shall entitle the BUYER to freely use the WORKS AND/OR EQUIPMENT, provided that the BUYER complies with the CONTRACTOR’s operation manuals relating to the WORKS AND/OR EQUIPMENT during the said period of use.

  • In any case, all CONTRACTOR’s subcontractors working on the concerned SITE for the implementation of any part of a CONTRACT shall have been duly, properly and prior insured for the risks related to their activities and works on SITE.Any failure to comply with these obligations may result in the non payment of the part(s) of the WORKS AND/OR EQUIPMENT achieved in such conditions, without prejudice of any claim for the damages suffered by the BUYER in connection therewith.

  • The CONTRACTOR shall also take all protective measures to avoid any nuisance to neighbours (especially in terms of noise, dust, oil and any other pollution) so that BUYER’s responsibility will not be investigated by any public administration or any third party in relation to the CONTRACT and/or the WORKS AND/OR EQUIPMENT, the CONTRACTOR being fully responsible for the consequences arising therefrom.

Related to WORKS AND/OR EQUIPMENT

  • Major Equipment means the items of Equipment listed as such in Attachment G.

  • Supplier Equipment means the Supplier's hardware, computer and telecoms devices, equipment, plant, materials and such other items supplied and used by the Supplier (but not hired, leased or loaned from the Customer) in the performance of its obligations under this Call Off Contract;

  • Customer Equipment means hardware, software, systems, cabling and facilities provided by you and used in conjunction with the Equipment that we supply to you in order to receive the Services;

  • Computer equipment means Covered Property that is electronic computer or other data processing equipment, including peripherals used in conjunction with such equipment, and electronic media and records.

  • Contractor Equipment means all appliances and things of whatsoever nature (other than temporary works) required for execution and completion of works and remedying of any defects, therein. But does not include plant, materials or other things intended to form or forming part of the permanent works.

  • Your Equipment means all equipment located after (downstream of) the point that electricity leaves the Meter at the premises which is used to take supply of or consume electricity except any Electricity Supply Equipment.

  • Semiconductor equipment means (i) machinery or tools or repair parts or replacements thereof; (ii)

  • Standard equipment means the basic configuration of a vehicle which is equipped with all the features that are required under the regulatory acts of the Contracting Party including all features that are fitted without giving rise to any further specifications on configuration or equipment level.

  • Fixtures and Equipment means, with respect to any Person, all of the furniture, fixtures, furnishings, machinery and equipment owned or leased by such Person and located in, at or upon the Assets of such Person.

  • Equipments and ‘Plants’ shall mean and include all sorts of machineries and accessories, apparatus, instruments, components manufactured articles and parts etc. to be supplied or provided by the contractor under the terms of the contract , unless otherwise specified

  • Inventory is all “inventory” as defined in the Code in effect on the date hereof with such additions to such term as may hereafter be made, and includes without limitation all merchandise, raw materials, parts, supplies, packing and shipping materials, work in process and finished products, including without limitation such inventory as is temporarily out of Borrower’s custody or possession or in transit and including any returned goods and any documents of title representing any of the above.

  • Farm equipment means equipment used directly for farming

  • Property, Plant and Equipment means any item of real property, or any interest therein, buildings, improvements and machinery.

  • BT Equipment means any equipment, including any Software, owned by or licensed to BT Group that is located at a Site for the provision of a Service.

  • Associated equipment means equipment that is used in conjunction with a radiographic exposure device to make radiographic exposures that drives, guides, or comes in contact with the source, e.g., guide tube, control tube, control (drive) cable, removable source stop, “J” tube and collimator when it is used as an exposure head.

  • Inventories means “Inventories” as defined in the Uniform System of Accounts, such as, but not limited to, provisions in storerooms, refrigerators, pantries and kitchens; beverages in wine cellars and bars; other merchandise intended for sale; fuel; mechanical supplies; stationery; and other expensed supplies and similar items.

  • Plant and Equipment means permanent plant, equipment, machinery, apparatus, articles and things of all kinds to be provided and incorporated in the Facilities by the Contractor under the Contract (including the spare parts to be supplied by the Contractor under GCC Sub-Clause 3.3 hereof), but does not include Contractor’s Equipment.

  • Third Party Equipment has the meaning given such term in Section 4.8 of this Agreement.

  • Machinery and equipment shall have the meaning specified in Section 1.1(c).

  • Excluded Equipment means (i) defibrillators, enhanced emergency medical kits and other medical equipment, (ii) airphones and other components or systems installed on or affixed to the Airframe that are used to provide individual telecommunications or electronic entertainment to passengers aboard the Aircraft, (iii) galley carts, beverage carts, waste containers, liquor kits, food tray carriers, ice containers, oven inserts, galley inserts, and other branded passenger convenience or service items, (iv) any items, equipment or systems leased by Company or any Permitted Lessee (other than items, equipment, or systems that are leased from Company pursuant to the applicable Lease) or owned by Company or any Permitted Lessee subject to a conditional sales agreement or a security interest (other than the security interest granted under the Indenture), and (v) cargo containers.

  • Installed means attached or connected such that an item requires tools for removal.

  • New equipment means equipment for which, by the cut-off date, neither of the following events has occurred:
