World Wide Acticoat definition

World Wide Acticoat. Trade-mxxx Registrations” means the trade-mxxx registrations and applications for registration in any jurisdiction included within the Territory for the Acticoat Trade-marks together with any new applications and registrations;
World Wide Acticoat. Trade-mxxx Rights” means 1.1.39.1. in the case of any Acticoat Trade-mxxx which has been used within any jurisdiction or for which an application has been filed or a registration has been obtained, all right, title and interest for that jurisdiction in and to such Acticoat Trade-mxxx, including, without limitation, all common law rights thereto, all statutory rights under the relevant trade-mxxx legislation, all copyrights therein and the Goodwill as symbolized; 1.1.39.2. in the case of any Acticoat Trade-mxxx that has not been used within any jurisdiction and for which no application for registration has been filed, the future right and opportunity to use and exploit such Acticoat Trade-mxxx within that jurisdiction, if any exists, and the right to apply for registration and obtain a registration for such Acticoat Trade-mxxx within that jurisdiction.

  • Nucryst shall not oppose any application by S&N to register the Acticoat Trade-marks in any jurisdiction included within the Territory, for any wares or services, or any application to extend any registration of the World Wide Acticoat Trade-mxxx Registrations.

  • To the Knowledge of Westaim, no other person is using any trade-marks or trade names which are the same as or similar to or likely to be confusing with or infringe upon Westaim’s rights in and to the World Wide Acticoat Trade-mxxx Registrations or the World Wide Acticoat Trade-mxxx Rights in the Territory.

  • To the Knowledge of Westaim, all registrations and filings necessary to preserve the World Wide Acticoat Trade-mxxx Registrations and to meet all applicable registration deadlines and requirements in the applicable jurisdictions have been made and the World Wide Acticoat Trade-mxxx Registrations are in good standing.

  • To the Knowledge of Westaim, no person has commenced any legal proceedings or otherwise asserted a claim which is on-going or unresolved as at the Effective Date alleging adverse ownership, invalidity, lack of distinctiveness or confusing similarity with respect to any of the World Wide Acticoat Trade-mxxx Registrations or World Wide Acticoat Trade-mxxx Rights or challenging any rights of Westaim thereto or the right of Westaim to use same to market, promote, distribute and sell any products or services.

  • Westaim has not granted any right capable of becoming an agreement or option for the purchase of any of the World Wide Acticoat Trade mxxx Registrations or the World Wide Acticoat Trade-mxxx Rights.

  • S&N shall, at S&N’s sole cost and expense, protect, defend and maintain the World Wide Acticoat Trade-mxxx Registrations in effect for the Term of this Agreement and shall use S&N’s best efforts to obtain registrations for any of the World Wide Acticoat Trade-mxxx Registrations that are the subject of a trade-mxxx application within any jurisdiction included within the Territory.

  • To the Knowledge of Westaim, the current use of the World Wide Acticoat Trade-mxxx Registrations and the World Wide Acticoat Trade-mxxx Rights do not conflict with, infringe upon or violate the trade-marks or intellectual property rights of any other person and Westaim has not received written notice of any allegation by any person to that effect.

  • As soon as reasonably practicable after the Closing Date, Westaim will deliver to S&N US executed assignments of the World Wide Acticoat Trade-mxxx Registrations and Word Wide Acticoat Trade-mxxx Rights.

  • Nucryst shall not, during the Term of this Agreement or thereafter, dispute, contest or challenge, directly or indirectly, the validity or enforceability of any one or more of the World Wide Acticoat Trade-mxxx Rights, the World Wide Acticoat Registrations or the ownership thereof by S&N, nor to counsel, procure, or assist anyone else to do the same.

  • The economic operator must meet the requirements on suitability in accordance with Law No. 04 L-042.

  • Internet Domain Names means all rights, title and interests (and all related IP Ancillary Rights) arising under any Requirement of Law in or relating to Internet domain names.

  • Internet Domain Name means all right, title and interest (and all related IP Ancillary Rights) arising under any Requirement of Law in or relating to internet domain names.

  • Domain Names means all Internet domain names and associated URL addresses in or to which any Grantor now or hereafter has any right, title or interest.

  • World Wide Web means an information browsing framework that allows a user to locate and access information stored on a remote computer and to follow references from one computer to related information on another computer; and

  • Domain Name means the domain name(s) (universal resource locators), and registration(s) thereof, issued by any Person or authority that issues and maintains the domain name registration; provided, however, “Domain Name” shall not include any trademark or service mark rights to such domain names other than the rights to the Product Trademarks required to be divested.

  • Metadata includes all information created manually or automatically to provide meaning or context to other data.

  • Internet Protocol or “IP” means a communications protocol for devices connected to the Internet that specifies the format for addresses and units of transmitted data.

  • Noncommercial computer software means software that does not qualify as commercial computer software under paragraph (a)(1) of this clause.

  • Computer software means computer programs, source code, source code listings, object code listings, design details, algorithms, processes, flow charts, formulae, and related material that would enable the software to be reproduced, recreated, or recompiled. Computer software does not include computer databases or computer software documentation.

  • Computer database or “database” means a collection of recorded information in a form capable of, and for the purpose of, being stored in, processed, and operated on by a computer. The term does not include computer software.

  • Research record means any data, document, computer file, computer diskette, or any other written or non-written account or object that reasonably may be expected to provide evidence or information regarding the proposed, conducted, or reported research that constitutes the subject of an allegation of research misconduct. A research record includes, but is not limited to, grant or contract applications, whether funded or unfunded; grant or contract progress and other reports; laboratory notebooks; notes; correspondence; videos; photographs; X-ray film; slides; biological materials; computer files and printouts; manuscripts and publications; equipment use logs; laboratory procurement records; animal facility records; human and animal subject protocols; consent forms; medical charts; and patient research files.

  • Websites means all Internet websites, including content, text, graphics, images, audio, video, data, databases, Software and related items included on or used in the operation of and maintenance thereof, and all documentation, ASP, HTML, DHTML, SHTML, and XML files, cgi and other scripts, subscriber data, archives, and server and traffic logs and all other tangible embodiments related to any of the foregoing.

  • Client Application means an application developed by Licensee that a) utilizes the Runtime Product, b) is installed fully on an end user’s machine, with all report processing local to that machine, and c) adds significant and primary functionality to the Runtime Product.

  • Business Software means with respect to a Licensor, all Software to the extent Controlled by such Licensor or any of its Affiliates as of the Effective Date, which Software is reasonably required as of the Effective Date for the conduct of (i) the Agriculture Business if the Licensee is AgCo, including as listed on section (i) of Schedule Q, or (ii) the Materials Science Business if the Licensee is MatCo, including as listed on section (ii) of Schedule Q, in each case (in respect of the foregoing (i) and (ii)), only if and to the extent such Licensee and its Affiliates have not been granted a license or other rights to use such Software under the Separation Agreement or any other Ancillary Agreement. Notwithstanding the foregoing, Business Software expressly excludes any and all Excluded IP.

  • maximum content of non-originating materials means the maximum content of non-originating materials which is permitted in order to consider a manufacture to be working or processing sufficient to confer originating status on the product.   • Computer Virus means a set of corrupting, harmful or otherwise unauthorized instructions or code including a set of maliciously introduced unauthorized instructions or code, programmatic or otherwise, that propagate themselves through a computer system or network of whatsoever nature. “Computer Virus” includes, but is not limited to, “Trojan Horses,” “worms” and “time or logic bombs”.

  • Brand Name Specification means a specification limited to one or more items by manufacturers’ names or catalogue number.

  • Trademarks means any trademarks, service marks, trade dress, trade names, brand names, internet domain names, designs, logos, or corporate names (including, in each case, the goodwill associated therewith), whether registered or unregistered, and all registrations and applications for registration and renewal thereof.

  • Web Site means the website that you are currently using (xxx.xxxxxxxxxxxxxxx.xx.xx) and any sub-domains of this site (e.g. xxxxxxxxx.xxx.xxxxxxxxxxxxxxx.xx.xx) unless expressly excluded by their own terms and conditions.
