  • As of the Effective Date the operation of the Xxxxxxxxxx Mine is not being carried out or developed by any Subsidiaries of the Borrower.

  • There are no material supplies, materials or equipment necessary for the operation or maintenance of the operation of the Xxxxxxxxxx Mine, that are not expected to be available at the operation of the Xxxxxxxxxx Mine on commercially reasonable terms consistent, in all material respects, with the annual business plan delivered in respect of the Borrower pursuant to Section 8.3(a)(v).

  • The Corporation and/or its Material Subsidiaries are party to collective bargaining agreements with their unionized employees, which will remain in effect until November 2017 (in the case of the unionized employees at the Xxxxxxxxxx Mine) and December 2017 (in the case of the unionized employees at the Corporation’s Manitoba operations), and expects to enter into new or extensions to such collective bargaining agreements on commercially reasonable terms.
