Common use of AWARD OF TENDER Clause in Contracts

AWARD OF TENDER. 9.1 After all steps of the Tender evaluation procedure the Tender Board shall establish tenders’ preliminary ranking. The preliminary ranking shall be done in the increasing price order. The Tender ranked first shall be the one with the lowest price. When there are several Tenders with the same price, the preceding into this row shall be written the Supplier, who has registered the Tender at the earliest. 9.2 If a single Tender has been submitted, the ranking of the Tenders shall not be performed, and the Supplier of such Tender shall be awarded the Contract if its Tender was not rejected during any stages of the Tender evaluation procedure. 9.3 Referring to the list confirmed by the Tender Board, the Buyer shall invite the Supplier who has offered the lowest price and therefore has been awarded the Contract to conclude it and shall indicate the Contract signing deadline. 9.4 If the Supplier invited to conclude the Contract refuses to do so (in writing) or does not arrive to conclude the Contract before the deadline specified by the Buyer, it shall be interpreted as the refusal to conclude the Contract. In such case, the Buyer shall propose the conclusion of the Contract to the Supplier, which is ranked next (by the approved ranking system) to the Supplier, which refused to conclude the Contract.
