Preamble. Deze algemene vervoersvoorwaarden zijn van toepassing op alle vervoersopdrachten geplaatst door en overeenkomsten gesloten met, en meer in het algemeen aangaande alle rechtsbetrekkingen met ECS NV en/of 2XL NV waarvan de maatschappelijke zetel gevestigd is te 0000 Xxxxxx, Xxxxx xx Xxxxxxxxx 000 en/of met elke dochtermaatschappij van ECS NV en/of 2XL NV (hierna te noemen "de opdrachtgever"), in verband met door de opdrachtgever bestelde vervoersopdrachten. De "vervoerder" in de zin van deze voorwaarden omvat allen die een vervoersopdracht aanvaarden of aanvaard hebben, met dien verstande dat de vervoerder door het aanvaarden of uitvoeren van de opdracht of het aangaan van een rechtsverhouding met de opdrachtgever, zich daartoe bevoegd verklaart en derhalve in staat stelt voor alle uit de opdracht voortvloeiende verplichtingen in te staan. De vervoerder verbindt zich ertoe in opdracht van de opdrachtgever en tegen vergoeding goederen over de weg te vervoeren met voertuigen. Dit vervoer kan geschieden hetzij door middel van gewoon vervoer (waarbij het vervoer geschiedt met eigen voertuigen), hetzij door middel van zogenaamd tractietransport, waarbij de vervoerder het vervoer verricht met eigen trekkend materieel en opleggers/chassis van de opdrachtgever. Partijen wijzen erop dat het zogeheten tractievervoer inderdaad een zelfstandige en toegestane activiteit is in de zin van art. 2.1 van verordening 1071/2009 en 2.1 van verordening 1072/2009. Deze voorwaarden vormen het kader waarbinnen de individuele transporten zullen worden uitgevoerd en vergoed. De vervoerder ontvangt een individuele vervoersopdracht voor elke opdracht om goederen te vervoeren. Door de opdracht te aanvaarden of uit te voeren, aanvaardt de vervoerder deze algemene voorwaarden. Deze voorwaarden hebben voorrang en sluiten alle andere voorwaarden uit van de vervoerder, tenzij uitdrukkelijk en schriftelijk anders overeengekomen door de opdrachtgever. Indien de vervoerder het NCA- of NAAF-leverancierscontract van de opdrachtgever zou hebben ondertekend, zijn deze voorwaarden een aanvulling op hetgeen in dat contract is overeengekomen. Deze Algemene Voorwaarden verplichten de Opdrachtgever op geen enkele wijze om (individuele) transportopdrachten te verstrekken aan de Vervoerder . The General Conference of the International Labour Organization, Having been convened at Geneva by the Governing Body of the International Labour Office, and having met in its ninety-sixth Session on 30 May 2007, and Noting the Vocational Training (Fishermen) Recommendation, 1966 (No. 126), and Taking into account the need to supersede the Work in Fishing Recommendation, 2005 (No. 196), which revised the Hours of Work (Fishing) Recommendation, 1920 (No. 7), and Having decided upon the adoption of certain proposals with regard to work in the fishing sector, which is the fourth item on the agenda of the session, and Having determined that these proposals shall take the form of a Recommendation supplementing the Work in Fishing Convention, 2007 (hereinafter referred to as “the Convention”) and superseding the Work in Fish- ing Recommendation, 2005 (No. 196); adopts this fourteenth day of June of the year two thousand and seven the following Recommendation, which may be cited as the Work in Fishing Recommendation, 2007.
