2. The administrator of personal data: The personal data administrator is the Supplier specified above in point II.7. (Definitions used in the Regulations). You will contact us via the contact tab provided to users after logging in to the xxxxxxxxxxxx.xx website ("Help" tab).
3. The source of your data: We collect user data from you as a result of completing information during registration in the Portal, as well as collected during the use of the Portal. In addition, the user can also indicate to us the recipients of the ordered meals, who are minors as well as adults.
4. Objectives and legal grounds for data processing: We process your data because it is necessary for us to perform a contract for the provision of catering services, in particular:
a) delivery of the ordered meal,
b) providing you with assistance and responding to messages that you send to us through a dedicated IT tool located on the Portal or in an e-mail,
c) in order to answer the submitted complaint,
d) sending you notifications related to the contract for the provision of services,

Protection of personal data. 1. Each Party to the Contract declares that they are the Data Controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the “GDPR”, with respect to the personal data of the Employees specified in the Contract. The personal data provided for the purposes of the Contract is the ordinary data and includes, in particular, name, surname, position held, phone number and e-mail address.
2. Personal data of the persons referred to in item 1 shall be processed by the Parties on the basis of Article 6(1)(f) of the RODO (i.e. processing is necessary for the purposes resulting from the legitimate interests pursued by the data controllers) only for the purpose and to the extent necessary to perform the tasks related to the implementation of the concluded Contract.
3. The Parties agree to protect the personal data provided to each other in connection with the performance of the Contract, including the implementation and application of technical and organizational measures ensuring an adequate level of security of personal data in accordance with legal provisions, in particular with the Act of 10 May 2018 on the protection of personal data [Journal of Laws of 24.05.2018 – item 1000] and the provisions of the GDPR. The Parties have complied with their information obligations to each other under Articles 13 and 14 of the RODO.
4. The Economic Operator declares that they have read the Information Clause of Exatel S.A., constituting Attachment No. 4 to the Contract.
Protection of personal data. 1. The Carrier may process the Passenger’s personal data without his or her consent, in order to per- form the services properly, under the Personal Data Protection Act and other applicable legal provi- sions.
2. The Carrier agrees to keep the data confidential and not to disclose them to any other entities unless the Passenger clearly authorises the Carrier to do so, or such authorisation results from legal regula - tions.
3. The Passenger has a legal right for an insight into the data given to the Carrier, as well as its change or update.

3. Personal data of Competition Participants (including Winners) may be processed for the following purposes and on the following legal grounds:
3.1. the conduct and implementation of the Competition, including the selection of Laureates and enabling the transfer of Prizes to them – the legal basis for data processing: art. 6 sec. 1 lit. f) GDPR;
3.2. ongoing communication in matters related to the conduct and implementation of the Competition – the legal basis for data processing: art. 6 sec. 1 lit. f) GDPR; 6.3.3 considering possible complaints related to the Competition – the legal basis for data processing: art. 6 sec. 1 lit. f) GDPR;
3.3. fulfillment of legal requirements in the field of tax and accounting regulations – the legal basis for data processing - art. 6 sec. 1 lit. c) GDPR;
Protection of personal data. 1. The controller of the personal data within the meaning of Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter "RODO") is ATS.
2. Dane przetwarzane są w celu realizacji współpracy, na podstawie zawartych umów, zamówień lub uzgodnień (dalej „Współpraca”).
3. Podstawą prawną przetwarzania w celu Współpracy jest wykonanie usługi przeładunku/magazynowania lub podjęcie działań niezbędnych do wykonania umowy przed jej zawarciem (art. 6 ust. 1 lit. b RODO). Podstawą prawną przetwarzania danych w celu wystawiania i przechowywania dokumentów sprzedażowych oraz innych dokumentów księgowych, a także w innych celach, w jakich Administrator jest zobowiązany przetwarzać dane osobowe na podstawie przepisu prawa, jest wypełnienie obowiązku prawnego ciążącego na Administratorze (art. 6 ust. 1 lit. c RODO). Podstawą przetwarzania danych w celach marketingowych jest dobrowolna zgoda (art. 6 ust. 1 lit. a RODO). Podstawą prawną przetwarzania danych w celu rozpatrzenia reklamacji jest wypełnienie obowiązku prawnego w postaci realizacji odpowiedzialności z tytułu rękojmi udzielonej w związku z realizacją usługi przeładunku/magazynowania (art. 6 ust. 1 lit. c w zw. z art. 6 ust. 1 lit. b RODO).
4. Dane są także przetwarzane na podstawie prawnie uzasadnionych interesów Administratora (art. 6 ust. 1 lit f RODO), a interesami tymi są: obrona i dochodzenie roszczeń, tworzenie zestawień, analiz i statystyk dotyczących satysfakcji z jakości świadczonych usług i oferowanych produktów oraz weryfikacja wiarygodności płatniczej kontrahentów.
5. Dane będą przetwarzane przez okres prowadzenia Współpracy, a po jego zakończeniu – do czasu przedawnienia roszczeń związanych ze Współpracą lub wygaśnięcia obowiązku archiwizacji danych wynikającego z przepisów prawa.
6. Dane osobowe mogą być przekazane podmiotom przetwarzającym je na zlecenie ATS (np. firmom świadczącym usługi księgowe i informatyczne, usługi transportowe, spedycyjne, kurierskie lub inne), ale tylko w celu i zakresie niezbędnym dla realizacji danej usługi.
7. Podanie danych osobowych jest dobrowolne ale niezbędne do realizacji Współpracy. Niepodanie danych osobowych może skutkować niemożnością przedstawienia oferty lub realizacji Współpracy.
8. Administrator nie przewiduje konieczności przekazywania danych osobowych poza EOG lub do organizacji międzynarodowej.
