RIGHTS AND OBLIGATIONS OF THE BANK. 1. Rights of the bank: a. To collect, use and check information provided by the Customer to decide whether to agree or refuse to issue the Card. b. To be released from all responsibilities to the Cardholder in the following cases: - The system suffers failures or is erroneous beyond control of the Bank. - The Bank, ATMs, POSs, Merchants and/or other means of payment refuse to make card transactions or reject PIN and/or OTP for any reason. - Failures occur due to force majeure events such as earthquakes, natural disasters, floods and wars. - Card transactions are made or consequences happen due to fraud, swindle, counterfeiting and/or sabotage. - Any card transaction is rejected by the Bank, Merchants and/or a Third party. - The Card is not secured or its PIN is disclosed due to faults and/or negligence of the Cardholder and other cases caused by faults of the Cardholder. - Delivery or quality of goods and services is paid via card transactions. c. The Bank has right to decide to withdraw the Card, stop and/or suspend Card services, prevent or reject card transactions and/or block the Card right after the following case arise: - The Card is suspected to be fake; - Card transactions are suspected to be not made by the Cardholder or to be against legal provisions; - Information provided by the Customer is suspected to be fake and inaccurate; - The Cardholder violates laws and/or regulations of the Bank; - At request of the competent authorities of the government; d. To provide the Cardholder's information related to the Card to any third party at the Bank’s own discretion.
RIGHTS AND OBLIGATIONS OF THE BANK. 1. Rights of the Bank a. Be exempt for all losses and damages of the Customer in case the Bank provides services via means of communication registered by the Customer but such means of communication are not used by the Customer any more and/or no longer exist but the Customer fails to register such changes with the Bank or for any reason resulting in failure of the Customer to receive services from the Bank. b. The Bank has right to automatically deduct the Customer's account in the following cases: − Due, overdue debts, interest and other legitimate costs are incurred during managing the account and providing payment services under regulations. − Payment obligations as decided by the competent authorities of the Government bind the Accountholder to pay. − Wrong crediting to the Customer's account is identified. − Refund to the Paying Bank in case the Customer cannot prove his/her legitimate ownership to credited sums within 05 business days from the date that the Bank notifies. − Other cases under agreements between the Customer and the Bank. c. To have right to reject payment orders of the Customer in the following cases: − The Customer fails to fully perform requirements on illegitimate payment procedures, payment orders against registered information or against agreements between the Bank and the Customer. − Account balance of the Customer is not enough or overdraft limit is exceeded to make payment orders. − In case of written requests of the competent authorities of the Government or proof of payment transactions for money laundering, terrorist financing under legal provisions of anti money laundering. − The account is being temporarily lock, wholly blocked, closed, or partially blocked and the available sum of that account is not sufficient (except overdraft) or overdraft limit is exceeded to make payment orders. d. In case violation of agreements with the Bank or signs of violation of laws by the account user are identified, the Bank shall have right to not perform the Customer's requests for use of payment services and have right to retain exhibits and immediately notify the competent authorities for consideration and handling.
