Communication a. The Bank shall be entitled to prescribe, from time to time, the form of notice (whether written or any other form) and the mode of communication with respect to each type of notice to be given pursuant to these Terms and Conditions. b. Communications delivered personally, sent by post, facsimile transmission, telex or e-mail shall be deemed to have been received by the Customer (where delivered personally) at the time of personal delivery or on leaving it at the address last notified in writing by the Customer to the Bank, (where sent by post by the Bank in the Hong Kong Special Administrative Region (“HKSAR”)) two days after posting if such address is in the HKSAR and seven days after posting if such address is outside the HKSAR (where sent by post by any of the Bank’s branches in China) three days after posting if such address is in China and seven days after posting if such address is outside mainland China or (where sent by facsimile transmission, telex or e-mail) immediately after transmitting to the facsimile or telex number or e-mail address last notified in writing by the Customer to the Bank. Communications sent by the Customer to the Bank shall be treated as delivered to the Bank on the day of actual receipt.
Communication. (a) Each Cardholder who is not a Principal Cardholder hereby irrevocably appoints the Principal Cardholder as his agent for the purposes of service by the Bank upon him of:- (i) the Statement, including service of the demand for payment thereby constituted and of any notice contained in the Statement for which provision is made in this Agreement; (ii) any other demand, communication or notice made or given by the Bank pursuant to any provision of this Agreement or otherwise for the purpose of or in connection with this Agreement; and (iii) legal process, in the event of any legal proceedings in respect of this Agreement. Further, any of the aforesaid documents to be given by the Bank to the Principal Cardholder shall be deemed to have been so given to each Supplementary Cardholder if posted to the Principal Cardholder and being served in the manner set out in Clause 14(b). (b) Any of the documents mentioned in Clause 14(a) may be served by sending the same by ordinary post to the usual or last known address of the Principal Cardholder as shown in the file record of the Bank, and such document shall be deemed to have been duly served two days after the date of posting if mailed to an address in Hong Kong or seven days after posting if mailed to an address outside Hong Kong, save that in the case of legal process these periods shall be changed to seven and twenty-one days respectively. Items sent to the Cardholder are sent at the Cardholder's risks. All notices or other communications sent by the Cardholder to the Bank shall be deemed to have been served on the date of actual receipt by the Bank. (c) (i) Notwithstanding anything contained in this Agreement to the contrary, the Bank is requested and authorized to act in accordance with and to rely on any instruction or other notice or communication (each a "notice" for the purpose of this sub-clause) which may be or purport to be given by the Cardholder.

Communications sent by the Customer to the Bank shall be treated as delivered to the Bank on the date of actual receipt.
Communication. 15.1 The Bank shall be entitled to prescribe, from time to time, the mode and format of communication with respect to each type of notice and the form of notice to be given pursuant to these Terms and Conditions. The mode and format includes SMS, public website notice, APP and WeChat official accounts. 15.2 Communications delivered personally, sent by post, facsimile transmission, telex or email shall be deemed to have been received by the Customer (where delivered personally) at the time of personal delivery or on leaving it at the address last address registered by the Customer to the Bank. (where sent by post) 48 hours after posting if such address is in a location where the account of the Customer is maintained and seven days after posting if such address is outside such a location or (where sent by facsimile transmission, telex or email) immediately after transmitting to the facsimile, telex number or email address last registered by the Customer to the Bank. Items sent to the Customer or delivered to an authorised representative are supplied at the customer's risk. 15.3 Unless otherwise specified by the Bank, all communications sent to the Customer to the Bank shall be in writing and fit applicable) in the form prescribed by the Bank and shall be sent to such address as the Bank may prescribe for such purpose and shall be treated as delivered to the Bank on the day of actual receipt.

Communication. 23.1 The Customer shall notify the Bank immediately upon any change of particulars of the Customer and/or any Authorized Person previously provided to the Bank, such as names, occupations, addresses, identification documents, telephone, facsimile or other contact numbers, partners (for partnership Accounts), directors and memorandum and articles of association (for corporate Accounts) and constitution and/or rules (for societies, clubs and other unincorporated associations). 23.2 All notices to and communications with the Customer, including any statement of account, confirmation advice, document, other instrument whatsoever (including cheque books) and/or PIN (hereinafter collectively called “Communications”) from or issued by the Bank may be sent by post, facsimile or other electronic transmission, hand-delivery or such other manner as the Bank deems fit to the last known address, facsimile or other relevant number of the Customer in the Bank’s records and shall be deemed (even if they could not be delivered or transmitted or were subsequently returned undelivered): (a) to have been received by the Customer two days after such posting, or on the day the facsimile or other electronic transmission or hand-delivery is despatched; and (b) to be effective service for the purpose for which such Communications was sent. All notices and other communications may also be given in the Bank’s branches or in the press (in one (1) daily newspaper) or any other media chosen by the Bank in its absolute discretion and the Customer shall be deemed to have received the same on the date of such publication. 23.3 The Customer shall not hold the Bank liable in the event any Communications is delayed, intercepted, lost and/or failed to reach the Customer during delivery, transmission or despatch, or if the content in such Communications is disclosed to any third party during transit. 23.4 The Customer consents, to the extent permitted by the applicable laws, to the effecting of personal service of any document which is required by any prevailing legislation and/or subsidiary legislation to be personally served, by way of registered post to the last known address to the Customer in the Bank’s records and also consents to such service being deemed as effective personal service four days after such document was posted by registered post as aforesaid, even if it could not be delivered or was returned undelivered. 23.5 A written statement by an officer of the Bank confirming the po...
Communication. 15.1 Communication, including any notices, copy of Precious Metals Contracts or daily or monthly statements in relation to the funds in the Client’s account and/or Investment orders, transaction made, may be made to the Client at the address of the Client given herein or at such other address as the Client may hereafter give to the Dealer in writing. All communication so made whether by post, telex, cable, fax, email, telephone, messenger or otherwise shall be deemed to have been given to the Client when deposited in the mail, received by a transmitting agent, transmitted by the sending machine, telephoned, delivered personally to the Client’s address, whether actually received or not. If the Client has any objection to the information, data, transaction record set out in any of the communication, the Client shall raise his objection, queries directly to the Dealer in writing within 7 Business Days from the date of deemed delivery, otherwise all such information, data and transaction records as contained in any means of communication from the Dealer will be deemed correct and the Client will be deemed to have fully accepted such information, data and transaction record. 15.2 All Notices, communications, account information and trading confirmation shall be deemed to be duly delivered to the Client:

(c) Nothing in this Agreement shall operate so as to exclude or restrict any liability, the exclusion or restriction of which is prohibited by the laws of Hong Kong. (d) If there is any inconsistency or conflict between the English version of this Agreement and the Chinese version, the English version shall prevail.
