Validity any provision, or part of a provision, of the Contract is found by any court or authority of competent jurisdiction to be illegal, invalid, or unenforceable, that provision or part-provision shall be deemed not to form part of the Contract and the legality, validity or enforceability of the remainder of the provisions of the Contract shall not be affected, unless otherwise required by operation of applicable law and the parties shall use reasonable endeavours to agree within a reasonable time on a full and reasonable variations to the Contract which may be necessary in order to achieve, to the greatest extent possible, the same commercial effect as would have been achieved by the provision, or part-provision, in question and with no fundamental change to the bargain between the parties.
