RIGHTS AND OBLIGATIONS OF THE CONTRACTOR. Art.10. (1)CONTRACTOR shall, at all stages of the contract to comply with the project documentation, technical specifications mandatory provisions of the LSP, regulating the obligation of the builder and designer by wearing full risk and responsibility for all hazards in the performance of work or supplied materials and equipment invested in construction during the entire contract period specified in section VIII of this contract. In case of contradiction or inconsistency between the texts of the documents under par. 1 priority documents when applying and interpreting them in the following order: 1. laws; 2. regulations; 3. standards and technical approvals; 4. The technical rules, norms and regulations issued by the ЕMEPA; 5. this contract; 6. technical specifications of the Contracting Authority; 7. technical requirements of the Investment project with the CSO to the execution of works and to input in building construction products; 8. The technical proposal of the Contractor; 9. The proposed price parameters of the Contractor; (2)Contractor shall develop investment project quality and within the agreed period, subject to the terms of reference for the design and current regulations, including requirements on labor safety, sanitary and fire regulations. The Contractor shall deliver to the Contracting Authority prepared investment project in five (5) hard copies and one (1) electronic copy (CD). The procedure for acceptance and approval of the drafted business (investment) project is carried out as follows: 1. THE CONTRACTING AUTHORITY assesses together with the Interim body (Ministry of Environment and Waters) under the Bulgarian-Swiss cooperation programme the working draft and approve or decide on the same within 10 (ten) working days after the occurrence of the following cumulative events: receipt by the Contractor of the prepared detailed design; ceptance of construction supervision of a report on the compliance assessment pursuant to Art. 142, para. 6 para. 2 of the Law on Spatial Planning. 2. If found comments/remarks/errors/discrepancies in the working draft, CONTRACTING AUTHORITY a notification letter within the period under item. 1 sends them to the Contractor for applying appropriate adjustments and corrections as CONTRACTOR has a period of 10 (ten) working days adjustment of the detailed design, then it is submitted to the contracting authority for approval. 3. RIGHTS AND OBLIGATIONS OF THE CONTRACTOR. 1. The Contractor shall provide qualified staff for the safe execution of the contractual activities. 2. The Contractor shall ensure that the persons who will carry out contractual activities are present at the initial instruction held prior to work commencement and at the instruction on the worksite as well as at any other instructions conducted by the Contracting Entity. 3. Before conduction of the initial instruction by the Contracting Entity, the Contractor shall submit a list of the names and the qualification group of each person, including the job managers and performers and the safety persons who will work on the site of the Contracting Entity. 4. When performing activities that require additional qualifications under the applicable regulations, the Contractor shall also furnish to the Contracting Entity the relevant qualification documents of its staff. 5. The Contractor’s staff shall while at work have on them their certificates of acquired qualification group in safety, as well as all documents proving the acquired qualifications. 6. RIGHTS AND OBLIGATIONS OF THE CONTRACTOR. 6.1 Contractor’s obligations 6.1.1 The Contractor is obliged to perform all surveys and gather all input data necessary for the full and good quality execution of the services and activities under this Contract, to co-ordinate them with the Contracting Entity and to submit to the latter a copy thereof. 6.1.2 The Contractor is obliged to submit to the Contracting Entity monthly written reports regarding the performance of his obligations under this Contract, and upon request to consult the Contracting Entity on issues related to the acquisition of the rights in rem necessary for the issuance of a building permit and for the implementation of the Project. 6.1.3 Upon confirmation by the Contracting Entity the Contractor is obliged to undertake all necessary legal and factual steps apart from the ones explicitly listed in article 2 (Scope of services) in view of achieving the goal of the assiggment of the services, namely the obtainment of a building permit for the Bulgarian part of the project Gas Interconnector Greece-Bulgaria. 6.1.4 The Contractor is obliged to make timely submissions of the whole information required by the Contracting Entity in the course of the implementation of the Contract. 6.1.5 The Contractor is obliged to provide the opportunity for the Contracting Entity to check the execution of the services and the activities contemplated under the Contract and shall strictly follow the instructions of the Contracting Entity in the course of implementing the Contract. 6.1.6 The Contractor is obliged to submit to the Contracting Entity all original documents related to the performance of the services under this Contract.
