Common use of 800/888 Traffic Clause in Contracts

800/888 Traffic. The following terms shall apply when either Party delivers 800/888 calls to the other Party for completion. 6.4.1 When ETC delivers translated 800/888 calls to BA for completion (a) to an IXC, ETC shall: (i) Provide a MPB record in an industry standard format to BA; and (ii) Xxxx the IXC the appropriate ETC query charge associated with the call. (b) as an IntraLATA call to BA or another LEC in the LATA, ETC shall: (i) Provide a copy record in an industry standard format to BA or the terminating LEC; (ii) Submit the call records to ITORP for payment by BA or the LEC that is the 800/888 service provider of ETC’s and any intermediate LEC’s Tariffed Exchange Access charges and query charges. 6.4.2 When BA delivers translated 800/888 calls originated by BA’s or another LEC’s Customers to ETC for completion (a) to ETC in its capacity as an IXC, BA shall: (i) Xxxx ETC the appropriate BA query charge associated with the call; and (ii) Xxxx ETC the appropriate FGD Exchange Access charges associated with the call. (b) as an IntraLATA call to ETC in its capacity as a LEC, (i) the originating LEC shall submit the appropriate call records to ITORP for payment by ETC of BA’s (and another LEC’s, if appropriate) tariffed Exchange Access charges; and (ii) ETC shall pay the originating LEC’s appropriate query charge associated with the call. 6.4.3 The settlement of all IntraLATA 800/888 calls exchanged pursuant to this subsection 6.4 shall be in accordance with the terms of an appropriate IntraLATA Telecommunications Services Settlement Agreement between the Parties substantially in the form appended hereto as Exhibit D.

(b) as an IntraLATA call to BA or another LEC in the LATA, ETC ANTC shall: (i) Provide a copy record in an industry standard format to BA or the terminating LEC;terminating (ii) Submit the call records to ITORP for payment by BA or the LEC that is the 800/888 service provider of ETCANTC’s and any intermediate LEC’s Tariffed Exchange Access charges and query charges. 6.4.2 When BA delivers translated 800/888 calls originated by BA’s or another LEC’s Customers to ETC ANTC for completion (a) to ETC ANTC in its capacity as an IXC, BA shall: (i) Xxxx ETC Bill ANTC the appropriate BA query charge associated with the call; and (ii) Xxxx ETC Bill ANTC the appropriate FGD Exchange Access charges associated with the call. (b) as an IntraLATA call to ETC ANTC in its capacity as a LEC, (i) the originating LEC shall submit the appropriate call records to ITORP BA for processing under the IntraLATA Toll Originating Responsibility Plan (“ITORP”) for payment by ETC ANTC of BA’s (and another LEC’s, if appropriate) tariffed Exchange Access charges; and (ii) ETC ANTC shall pay the originating LEC’s appropriate query charge associated with the call. 6.4.3 The settlement of all IntraLATA 800/888 calls exchanged pursuant to this subsection Subsection 6.4 shall be in accordance with the terms of an appropriate IntraLATA Telecommunications Services Settlement Agreement between the Parties substantially in the form appended hereto as Exhibit D.

(b) as an IntraLATA call to ETC TCG in its capacity as a LEC, (i) the originating LEC shall submit the appropriate call records to ITORP BA for processing under the IntraLATA Toll Originating Responsibility Plan (“ITORP”) for payment by ETC TCG of BA’s (and another LEC’s, if appropriate) tariffed Exchange Access charges; and (ii) ETC TCG shall pay the originating LEC’s appropriate query charge associated with the call. 6.4.3 The settlement of all IntraLATA 800/888 calls exchanged pursuant to this subsection 6.4 shall be in accordance with the terms of an appropriate IntraLATA Telecommunications Services Settlement Agreement between the Parties substantially in the form appended hereto as Exhibit D.

(b) as an IntraLATA call to ETC TCG in its capacity as a LEC, (i) the originating LEC shall submit the appropriate call records to ITORP BA for processing under the IntraLATA Toll Originating Responsibility Plan (“ITORP”) for payment by ETC TCG of BA’s (and another LEC’s, if appropriate) tariffed Exchange Access charges; and (ii) ETC TCG shall pay the originating LEC’s appropriate query charge associated with the call. 6.4.3 The settlement of all IntraLATA 800/888 calls exchanged pursuant to this subsection 6.4 shall be in accordance with the terms of an appropriate IntraLATA Telecommunications Services Settlement Agreement between the Parties substantially in the form appended hereto as Exhibit D.

(b) as an IntraLATA call to BA or another LEC in the LATA, ETC Covad shall: (i) Provide a copy record in an industry standard format to BA or the terminating LEC; (ii) Submit the call records to ITORP for payment by BA or the LEC that is the 800/888 service provider of ETCCovad’s and any intermediate LEC’s Tariffed Exchange Access charges and query charges. 6.4.2 When BA delivers translated 800/888 calls originated by BA’s or another LEC’s Customers to ETC Covad for completion (a) to ETC Covad in its capacity as an IXC, BA shall: (i) Xxxx ETC Covad the appropriate BA query charge associated with the call; and (ii) Xxxx ETC Covad the appropriate FGD Exchange Access charges associated with the call. (b) as an IntraLATA call to ETC Covad in its capacity as a LEC, (i) the originating LEC shall submit the appropriate call records to ITORP BA for processing under the IntraLATA Toll Originating Responsibility Plan (“ITORP”) for payment by ETC Covad of BA’s (and another LEC’s, if appropriate) tariffed Exchange Access charges; and (ii) ETC Covad shall pay the originating LEC’s appropriate query charge associated with the call. 6.4.3 The settlement of all IntraLATA 800/888 calls exchanged pursuant to this subsection 6.4 shall be in accordance with the terms of an appropriate IntraLATA Telecommunications Services Settlement Agreement between the Parties substantially in the form appended hereto as Exhibit D.

(b) as an IntraLATA call to BA or another LEC in the LATA, ETC ICI shall: (i) Provide a copy record in an industry standard format to BA or the terminating LEC; (ii) Submit the call records to ITORP for payment by BA or the LEC that is the 800/888 service provider of ETCICI’s and any intermediate LEC’s Tariffed Exchange Access charges and query charges. 6.4.2 When BA delivers translated 800/888 calls originated by BA’s or another LEC’s Customers to ETC ICI for completion (a) to ETC ICI in its capacity as an IXC, BA shall: (i) Xxxx ETC Bill ICI the appropriate BA query charge associated with the call; and (ii) Xxxx ETC Bill ICI the appropriate FGD Exchange Access charges associated with the call. (b) as an IntraLATA call to ETC ICI in its capacity as a LEC, (i) the originating LEC shall submit the appropriate call records to ITORP BA for processing under the IntraLATA Toll Originating Responsibility Plan (“ITORP”) for payment by ETC ICI of BA’s (and another LEC’s, if appropriate) tariffed Exchange Access charges; and (ii) ETC ICI shall pay the originating LEC’s appropriate query charge associated with the call. 6.4.3 The settlement of all IntraLATA 800/888 calls exchanged pursuant to this subsection 6.4 shall be in accordance with the terms of an appropriate IntraLATA Telecommunications Services Settlement Agreement between the Parties substantially in the form appended hereto as Exhibit D.

(b) as an IntraLATA call to BA or another LEC in the LATA, ETC KMC shall: (i) Provide a copy record in an industry standard format to BA or the terminating LEC; (ii) Submit the call records to ITORP for payment by BA or the LEC that is the 800/888 service provider of ETCKMC’s and any intermediate LEC’s Tariffed Exchange Access charges and query charges. 6.4.2 When BA delivers translated 800/888 calls originated by BA’s or another LEC’s Customers to ETC KMC for completion (a) to ETC KMC in its capacity as an IXC, BA shall: (i) Xxxx ETC KMC the appropriate BA query charge associated with the call; and (ii) Xxxx ETC KMC the appropriate FGD Exchange Access charges associated with the call. (b) as an IntraLATA call to ETC KMC in its capacity as a LEC, (i) the originating LEC shall submit the appropriate call records to ITORP BA for processing under the IntraLATA Toll Originating Responsibility Plan (“ITORP”) for payment by ETC KMC of BA’s (and another LEC’s, if appropriate) tariffed Exchange Access charges; and (ii) ETC KMC shall pay the originating LEC’s appropriate query charge associated with the call. 6.4.3 The settlement of all IntraLATA 800/888 calls exchanged pursuant to this subsection 6.4 shall be in accordance with the terms of an appropriate IntraLATA Telecommunications Services Settlement Agreement between the Parties substantially in the form appended hereto as Exhibit D.

(b) as an IntraLATA call to BA or another LEC in the LATA, ETC ACI shall: (i) Provide a copy record in an industry standard format to BA or the terminating LEC; (ii) Submit the call records to ITORP for payment by BA or the LEC that is the 800/888 service provider of ETCACI’s and any intermediate LEC’s Tariffed Exchange Access charges and query charges. 6.4.2 When BA delivers translated 800/888 calls originated by BA’s or another LEC’s Customers to ETC ACI for completion (a) to ETC ACI in its capacity as an IXC, BA shall: (i) Xxxx ETC ACI the appropriate BA query charge associated with the call; and (ii) Xxxx ETC ACI the appropriate FGD Exchange Access charges associated with the call. (b) as an IntraLATA call to ETC ACI in its capacity as a LEC, (i) the originating LEC shall submit the appropriate call records to ITORP BA for processing under the IntraLATA Toll Originating Responsibility Plan (“ITORP”) for payment by ETC ACI of BA’s (and another LEC’s, if appropriate) tariffed Exchange Access charges; and (ii) ETC ACI shall pay the originating LEC’s appropriate query charge associated with the call. 6.4.3 The settlement of all IntraLATA 800/888 calls exchanged pursuant to this subsection 6.4 shall be in accordance with the terms of an appropriate IntraLATA Telecommunications Services Settlement Agreement between the Parties substantially in the form appended hereto as Exhibit D.

(b) as an IntraLATA call to BA or another LEC in the LATA, ETC Commonwealth shall: (i) Provide a copy record in an industry standard format to BA or the terminating LEC; (ii) Submit the call records to ITORP for payment by BA or the LEC that is the 800/888 service provider of ETCCommonwealth’s and any intermediate LEC’s Tariffed Exchange Access charges and query charges. 6.4.2 When BA delivers translated 800/888 calls originated by BA’s or another LEC’s Customers to ETC Commonwealth for completion (a) to ETC Commonwealth in its capacity as an IXC, BA shall: (i) Xxxx ETC Bill Commonwealth the appropriate BA query charge associated with the call; and (ii) Xxxx ETC Bill Commonwealth the appropriate FGD Exchange Access charges associated with the call. (b) as an IntraLATA call to ETC Commonwealth in its capacity as a LEC, (i) the originating LEC shall submit the appropriate call records to ITORP for payment by ETC Commonwealth of BA’s (and another LEC’s, if appropriate) tariffed Exchange Access charges; and (ii) ETC Commonwealth shall pay the originating LEC’s appropriate query charge associated with the call. 6.4.3 The settlement of all IntraLATA 800/888 calls exchanged pursuant to this subsection 6.4 shall be in accordance with the terms of an appropriate IntraLATA Telecommunications Services Settlement Agreement between the Parties substantially in the form appended hereto as Exhibit D.
